THIS DEED, made this 10th day of May
between BESSIE E. LINDAUER, of Grand Valley, County of
Garfield and State of Colorado, of the first part, and JOYCE
RISLEY, P.O. Box 271, Grand Valley, County of Garfield and
State of Colorado, of the second part;
WITNESSETH, That the said party of the first part,
for and in consideration of the sum of Ten Dollars and other
good and valuable consideration, to the said party of the
first part, in hand paid by the said party of the second
part, the receipt whereof is hereby confessed and acknowledged,
has granted, bargained, sold and conveyed, and by these
presents does grant, bargain, sell, convey and confirm unto
the said party of the second part, her heirs and assigns
forever, all the following described parcel of land, lying
and being in the County of Garfield and State of Colorado,
to -wit:
A tract of land in the Northeast 4 of Section
13, Township 7 South, Range 96 West of the 6th Principal
Meridian, Garfield County, Colorado, more particularly
described as follows:
Beginning at the Northwest Corner of the
tract, from which the Northwest Corner of Section 13,
Township 7 South, Range 96 West, of the 6th Principal
Meridian bears N. 57°06'50" W. 3281.32 feet; thence S.
34°13' E. 685.29 feet; thence N. 48°02' E. 595.44
feet; thence N. 57°16' E. 195.03 feet; thence N.
43°42' E. 138.82 feet; thence N. 29°57' E. 193.42
feet; thence N. 00°15' W. 69.50 feet; thence N.
51°38' W. 230.86 feet; thence N. 56°58' W. 284.73
feet; thence N. 87°48' W. 305.91 feet; thence S.
38°02' W. 124.16 feet; thence S. 38°09' W. 619.09
feet to the point of beginning.
The above tract of land contains 17.734
acres, more or less, together with an easement, 138.82
feet in width, to the Colorado River, and more parti-
cularly described as follows: beginning at the
Northwest Corner of the tract, from which the Northwest
Corner of Section 13, Township 7 South, Range 96 West
of the 6th Principal Meridian, bears N. 57°06'50" W.
3281.32 feet; thence S. 34°13' E. 685.29 feet; thence
N. 48°02' E. 595.44 feet; thence N. 57°16' E. 195.03
feet to the Northwest Corner of the easement; thence
along the Northwest boundary of the easement N. 43°42'
E. 69.41 feet to a point bn the Easterly 7.724 acres

and a point at the beginning, and center line, of the
easement; thence S. 46°18' E. along the center line of
the easement, and to the -intersection of the Colorado
River. Said easement is for access to the Colorado
River, for the purpose of fishing and boating.
Together with 17/30 c.f.s. out of the first
party's water right in the Van Horn Ditch.
Reserving unto party of the first part one-half
(/) of the oil, gas and other minerals under said
property, together with a right of way 50 feet in
width, being 25 feet on each side of the center line
of the Van Horn Ditch as it crosses the above described

and appurtenances thereunto belonging, or in anywise appertaining,
and the reversion and reversions, remainder and remainders,
rents, issues and profits thereof; and all the estate,

said party of the first part, either in law or equity, of,
in and to the above bargained premises, with the hereditaments
and appurtenances; TO HAVE AND TO HOLD the said premises
above bargained and described, with the appurtenances, unto
JOYCE RISLEY, the said party of the second part, her heirs
and assigns forever, subject to patent reservations, easements
and rights of way of record and in use.
And the said BESSIE E. LINDAUER, party of the
first part, for herself, her heirs, executors and administrators,
does,covenant,grant, bargain and agree to and with the said
party of the second part, her heirs and assigns, the above
bargained premises in the quiet and peaceable possession of
said party of the second part, her heirs and assigns, against
all and every person or persons lawfully claiming or to
claim the whole or any part thereof, by, through or under
the said party of the first part to WARRANT AND FOREVER
DEFEND.

RULING OF REFEREE
The above entitled application was filed on December 21, 1979,
and was referred to the undersigned as Water Referee for Water
Division No. 5, State of Colorado, by the Water Judge of said Court
on the 12th day of January, 1980, in accordance with Article 92 of
Chapter 37, Colorado Revised Statutes 1973, Known as The Water Right
Determination and Administration Act of 1969.
And the undersigned Referee having made such investigations as
are necessary to determine whether or not the statements in the
application are true and having become fully advised with respect
to the subject matter of the application does hereby make the following
determination and ruling as the Referee in this matter, to -wit:
1. The statements in the application are true.
2. The name of the structure is Joy -Ridge Well No. 1.
3. The name of the claimant and address is Joyce Risley;
P.O. Box 271; Grand Valley, Colorado.
4. The source of the water is a well having a depth of 24 feet,
and being tributary to the Colorado River.
5. The well is located in the NWQ SEn of Section 13, T. 7 S.,
R. 96 W. of the 6th P.M. at a point 1,820 feet north of the Southline
and 2,300 feet west of the Eastline of said Section 13.
6. On December 29, 1975, in Case No. W-2779, the Water Referee
for Water Division No. 5 awarded to the Joy -Ridge Well No. 1, an
absolute water right for 3,0,73 cubic foot of water per second of
time and a conditional water_right for 0.319 cubic foot of water
per second of time, to be used for commercial, domestic, fire pro-
tection a tion purposes, wiEh appropria ion •a u y 7,
1 . The claimant was diverted'to file an application for quadrennial
finding of reasonle diligence in the development of the conditional
portion of the Decree in December of 1979 to maintain the conditional
water right in full force and effect. This Ruling of the Referee was
confirmed and made a Decree of the Court on April 26, 1976.
7. On December 21, 1979, the claimant filed, in Water Court for
Water'Division No. 5, an application to make absolute a conditional
water right, in which it is requested that the 0.319 cubic foot -of
water per second of time previously awarded conditionally to Joy -Ridge
Well No. 1, be made absolute and unconditional be reason of the
completion of the appropriation and application of the water to
beneficia]. use.
In support of this request it is stated by the claimant that
a pump has been installed in the well of sufficient size to produce
the total amount of water adjudicated to the well. A sprinkler system
has been installed and the water was first applied to beneficial use
to irrigate 17.724 acres in April 1976.

The Referee does, therefore, conclude that the above entitled
application should be granted and that 0.319 cubic foot of water
per second of time, date of priority, July 17, 1974, decreed
conditionally to the Joy -Ridge Well. No. 1, for commercial, domestic,
fire protection, and irrigation be made adsolute and unconditional.
It is accordingly ORDERED that this ruling shall be filed
with the Water Clerk and shall become effective upon such filing,
subject to Judicial review pursuant to Section 37-92-304 CRS 1973.
It is further ORDERED that a copy of this ruling shall be filed
with the appropriate Division Engineer and the State Engineer.

WITNESSETH, that the said party of the first part, for and in consideration
of the sum of Ten Dollars and other good and valuable consideration, to the
said party of the first part, in hand paid by the said party of the second
part, the receipt whereof is hereby confessed and acknowledged, has granted,
bargained, sold and conveyed, and by these presents does grant, bargain,
sell, convey and confirm unto the said party of the second part, her heirs
and assigns forever, all the following described parcel of land, lying
and being in the County of Garfield and State of Colorado, to -wit:
A tract of land in the SW1/4 NE1/4 Section 13, T.7S, R.96W., 6th P.M.,
Garfield County, Colorado, and more particularly described as follows:
Beginning at a point on the Westerly Line of said tract, whence the
Northwest Corner of Section 13, T.7S, R.96W., 6th P.M. bears N57°06'50"W
a distance of 3281.32 feet; thence S34°13'E a distance of 685.29 feet;
thence N48°02'E a distance of 308.31 feet; thence N34°13'W a distance
of 740.82 feet; thence S38°09'W a distance of 320.56 feet to the point
of beginning.
The above tract of land contains 5.00 acres more or less, together with
an easement, 20 feet in width, and more particularly described as follows:
beginning at the Northwest Corner of the tract, from which the Northwest
Corner of Section 13, Township 7 South, Range 96 West of the 6th
Principal Meridian, bears N. 57°06'50" W. 3281.32 feet; thence S.34°13' E
685.29 feet; thence N. 48°02' E. 308.31 feet to the Southeast Corner
of the easement: thence along the South east boundary of the easement
N. 48°02' E. 287.13 feet; thence N. 34°13' W. 20 feet; thence S.48002' W.
287.13 feet; thence S. 34013' E. 20 feet to a point of beginning. Said
easement is for access to an existing roadway now in place and in use.
Reserving unto party of the first part the right of first refusal to purchase
said parcel of land upon such terms and conditions as party of the second
part may extend in the future to third parties not privy in this agreement.
Together with all and singular the hereditaments and appurtenances thereunto
belonging, or in anywise appertaining, and the reversion and reversions,
remainder and remainders, rents, issues and profits thereof; and all the estate,
right, title, interest, claim and demand whatsoever, of the said party of
the first part, either in law or equity, of, in and to the above bargained
premises, with the hereditaments and appurtenances; TO HAVE AND TO HOLD the
said premises above bargained and described, with the appurtenances, unto
JACQUELINE HATMAKER, the said party of the second part, her heirs and assigns
forever, subject to patent reservations, easements and rights of way of record
and in use and to taxes for the year 1981 due in 1982.

And the said JOYCE RISLEY, party of the first part, for herself, her heirs,
executors and administrators, does convenant, grant, bargain and agree to
and with the said party of the second part, her heirs and assigns, the above
bargained premises in the quiet and peaceable possession of said party of the
second part, her heirs and assigns, against all and every person or persons
lawfully claiming or to claim the whole or any part thereof, by, throught or
under the said party of the first part to WARRANT AND FOREVER DEFEND.
