Rhodes , County Attorney Leanne Cleland , Clerk of the Board meeting of the Board of County Commissioners for Garfield County, Colorado, Tuesday the 24Th day of when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 81-356 A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD C UNTY.SUBDIVISION REGULATIONS FOR JOYCE;RISLEY. WHEREAS, Joyce Risley has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption.. fromthe definition ofthe terms "subdivided land" and "subdivision" under C.R.S. 1973,:30. -L8 -101 (a) -(d), as amended, and the Subdivision Regulations. of Garfield County, Colorado, adopted January 2, 1979, Sections -2.02.21 (d) and 3.02.01 for the division of a 17.734 'acre tract described as follows: that parcel of land as described in Document No. 294024 as filed in the office of the Clerk and Recorder of Garfield County, Colorado into 2 tracts of approximately 5 and 12.734 acres, more or less, whichproposed divided tracts are more particularly described as follows: Tract A: A:tract of land'in the SW4 NE4 Section 13, T7S, R96W, 6th PM, Garfield County, Colorado, and more particularly described as follows: Beginning at•a,point on the Westerly Line of said tract, whence the Northwest Corner of. Section 13, T7S, R96W;.6th:PM bears N57°06'50"W a distance of 3281.32 feet; thence S34°137E a distance of 685.29 feet; thence N48°027E a distance of ' 308.31 'feet; thence..N34°131W a distance. of 740.82 feet; thence S38°09'W a distance of 320.56 feet to the Doint:of beginning. The above tract of lard contains 5.00 acres•more or less, together with an easement, 20 feet in width, and more particulary described as follows: Beginning at the Northwest Corner of the tract, from which the Northwest Corner of Section 13.., T7S,'R96W of the. 6th PM; bears N57°06750"W, 3281,32 -feet; thence • S34°13'E, 685.29 feet;' thence N48°02'E,.308.31 feet to the Southeast Corner of the easement: `thence along the South east boundary of the easement N48°027E, 287.13 feet; thence N34°13'W, 20 feet; thence 48°02'W, 287.13 feet; thence S34°13'E;-:20 feet to a point of. beginning.. Said easement is for access to an existing roadway now in_place and in use. Tract B: the remaining 12.734 acres. WHEREAS, the,Petitioner ha,s demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed. division does .not fall within the purposes of Part 1,: Article 28, Title 30; Colorado Revised Statutes 1973, as amended, 'for the reason that the impact created does not warrent further subdivision review; and WHEREAS; the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado,•that there is reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the.requested division is not,.part of an existing.or larger development dhd does not fall within the general purposes and intent of the subdivision regulations of the State of Colorado and the County.of Garfield, and should, therefore, be exempted from the definition of the terms "subdivided land" and "subdivision" as set forth in the C.R.S. 1973, 30-28-101 (10) (a) -(d), as amended BfiOX 587 Pa 3E669 .NOW, THEREFORE, BE IS RESOLVED that the division of the above described tracts "A", aDd "B " from'the above described 17:734 acre tract is hereby exempted from such definitions and said tract may be divided into tracts "A" and "B" all as is more fully described;. above, and said divided tract may be conveyed in the form of such smaller tracts without•further compliance with the aforesaid subdivision statutes and regulations provided, however, that this exemption is granted on' the condition and with the express understanding and:agreement of the Petitioner that no further exemptions be allowed on said tracts`"A" and "B" and that a copy of the instrument or instruments of conveyance when recorded shall be filed with this Resolution. • ATTEST: BOARD OF COUNTY COMMISSIONERS GARFIELD COUNTY., COLORADO Deputy Clerk of the Board Chairman Upon motion duly made and seconded the foregoing Resolution was adopted by the following vote: Larry Vela.$.Cjl,ZPrg Aye Flaven J.
