HomeMy WebLinkAbout2.0 ResolutionRESOLUTION WHEREAS, CALVIN D. ROBERTS, has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30- 28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections 1.02.17(d) and 3.02.01, for the division of a 721 acre tract of land into four tracts of approximately 3, 3, 3, and 712 acres, more or less, and said 721.38 acre tract of land is more particularly described as follows: Lot Three (3), the Southeast Quarter of the Northwest Quarter (SE1/4NW4), the East Half of the Southwest Quarter (:,SW4) and t",e South of the Northeast QudrtC`^ (SZNE4) of Section One (1), Township Five (5) South, Range Ninety -Two (92) West of the Sixth Principal Meridian, containing 160.38 acres. Also the South Half of the Southeast Quarter (S1/2SE4) of Section Six (6), the South Half of the Southwest Quarter (S1/2SW4), the Northeast Quarter of the Southwest Quarter (NE4SW4) and the West Half of the Southeast Quarter (W12SE4) of Section Five (5), and the Northwest Quarter of the Northeast Quarter (NW4NE4) of Section Eight (8), Township Five (5) South, Range Ninety -One (91) West of the Sixth Principal Meridian, containing 320 acres. Lots 5 and 6, the SE4NW4 and NE4SW4 of Section 6, Township 5 South, Range 91 West of the Sixth Principal Meridian, containing 241 acres. WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that he desires said exemption for the purpose of re -sale into single-family residential acreage; and, WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board of County Commissioners that there is a reasonable probability of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that the requested division is in accordance with the general purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield and should, therefore, be exempted from the definition of the terms "subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended; NOW THEREFORE, upon motion of . ()---)0/l°Lj and carried, said 721.38 acre tract of land is Auto,, J _e_. seconded by hereby exempted from such definition and transfer of said tract may be made by division into four tracts of approximately 3, 3, 3, and 712 acres, more or less, all as is more fully described above and further, that said exemption is conditioned upon the Petitioner obtaining a proper legal description of said tracts prior to any conveyance thereof, and that Petitioner supply the three acre parcels with potable domestic water prior to conveyance. A copy of the instrument(s) of conveyance when recorded shall be filed with this Resolution.
