R E S O L U T I O N 1 7'7- IOS
WHEREAS,WARREN ROBERTS has petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section
30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield
County, Colorado, adopted September 1, 1972 and amended April 14, 1975,
Sections 1.02.17 (d) and 3.02.01, for the division of a 174 acre tract of
land into two tracts of 6.2 acres and 167.8 acres, more or less, and said
174 acre tract more particularly described as follows:
TOWNSHIP 5 SOUTH, RANGE 91 WEST OF THE 6th P.M., COLORADO
The NE4SW4 and a portion of the NW'4SW4, all in Section 18,
described as follows:
Beginning at a point on the centerline of the County Road which
is North 120 46' East a distance of 1341.14 feet from the
Southwest Corner of Section 18, Township 5 South, Range 91 West,
6th P.M., thence along said centerline North 22° 06' East 24.48
feet; thence North 080 48' East 544.87 feet; thence leaving said
centerline North 870 52' East 1033.70 feet; thence North 000
19' West 707.72 feet; thence South 89° 48' 24" East 1279.74 feet
to the center of said Section 18; thence South 000 02' 54" East
1320.10 feet; thence North 890 35' 40" West 2402.96 feet to the
point of beginning.
Except a 30 foot roadway across subject property described as
follows:
Beginning at a point in the County Road right-of-way which is North
140 56' 20" East 1463.66 feet from the Southwest Corner of said
Section 18, thence along the centerline of said roadway North
280 57' East 355.8 feet; thence North 410 32' East 173.3 feet;
thence South 560 19' East 238.2 feet; thence South 790 45' East
267.8 feet; thence South 810 20' East 301.7 feet; thence South
770 28' East 2.19.53 feet; thence North 200 21' East 260.85 feet;
thence North 14° 22' East 592.38 feet; thence South 85° 03' East

of said Section 18; thence along the centerline of said roadway

18; thence along the centerline of said roadway North 840 01' East

boundary of said Parcel from whence the East 4 corner of said Section
18 is North 00° 10' 58" West 613.36 feet and South 890 48' 24" East
1340.13 feet.

Beginning at a point on the West boundary of said Parcel which is
North 890 48' 24" West 1340.13 feet and South 000 10' 58" East
613.36 feet from the East 4 Corner of said Section 18; thence along
the centerline of said raodway South 710 47' East 177.92 feet;
thence North 100 09' West 257.24 feet; thence North 710 51' East
174.41 feet; thence North 280 14' East 385.92 feet; thence North
89° 54' East 866.28 feet to the East boundary of said Parcel from
whence the East 4 Corner of said Section 18 is North 00° 19' West
15.5 feet.
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners of Garfield County, Colorado, that he desires said
exemption for the purpose of re -sale into single-family residential acreage;
and,
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners that there is a reasonable probability of locating
domestic water on each of said tracts, that there is adequate ingress and
egress to said tracts, that the location of septic tanks will be permitted by
the Colorado Department of Health, that the requested division is in accordance
with the general purposes and intent of the Subdivision Regulations of the

State of Colorado and the County of Garfield and should, therefore, be
exempted from the definition of the terms "subdivision" and "subdivision land"
as set forth in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended;
NOW THEREFORE, upon motion of Lown,./
Ari&uutA aC,-, and carried, said 174 acre tract of land is
hereby exempted from such definition and transfer of said tract may be made
by division into two tracts of 6.2 acre and 167.8 acres, more or less, all as
is more fully described above and further, that said exemption is conditioned
upon the Petitioner obtaining a proper legal description of said tracts prior
to any conveyance thereof. A copy of the instrument(s) of conveyance when
recorded shall be filed with this Resolution.
