10:45 A.M. Adair Rippy- SB -35 Exemption
REQUEST: To create four parcels of land from the existing 17 acre parcel.
Two (2) parcels will be approximately 2 acres in size and the
other two (2) will be approximately 6 acres each,
LOCATION: Approximately 4 miles east of Silt off of I-70 Frontage Road.
ZONING: A/I
QUALIFICATION: Applicant has owned the parcel for over five years and the
split will create no more than three new tracts of land
under 35 acres in size.
WATER: From a well drilled by the Colorado State Department of Highways
in exchange for paving over the applicant's previous existing
well. (Note this well is not presently registered with the
Colorado Division of Water Resources)
SEWER: From proposed individual septic
COMP PLAN: This parcel lies within New Castle's Urban Area of Influence and
consequently conforms with the two acre minimum lot size recommended
in the comp plan.
COMMENTS: This request meets all of the requirements for exemption from the
subdivision process as set forth in Resolution No. 80-65.
There are existing lots of less than 2 acres contiguous to this
proposal and it is in compliance with the County Comp Plan.
RECOMMENDATION: Approval with the following conditions:
1) The existing well be registered with the Colorado Division of Water
Resources prior to issuance of the resolution.
2) A water line and maintenance easement to the well and a 1/3 interest
in the well be allowed for each parcel.
3) The proposed 30 foot roadway easement, providing interior access to the
three western lots, be written into the legal descriptions to be
provided prior to resolution.
4) Receipt of $600.00 school assessment prior to drawing of a resolution
approving this request.
