when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO, 87-130
A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY
SUBDIVISION REGULATIONS FOR MILES AND TERESA RIPPY
WHEREAS, Miles and Teresa Rippy have. petitioned the Board of County
Commissioners of Garfield County, --Colorado, for an, -exemption from the
definition of the terms "subdivision" and "subdivided land under C.R.S.
1973, 30-28-101 (10) (a)-(d),,as amended, and the Subdivision Regulations
of Garfield County, Colorado,:adopted-April 23, 1984,Section 800 through
8:60 and for the division of a-20.36 acre tract as described in Book 390,
Page 567, as :'filed in the Office of the Clerk and.Recorder of Garfield
County, Colorado into two tracts of5.00 acres and. 15:36 `acres, more or
less, which proposed divided tracts are more practically described'as
follows:
TRACT A: See attached legal description;
TRACT B: That property described in Reception #239689, recorded in
Book 390, Page 5.67, less that property described as Tract. Al
(in the State of Colorado and the County of Garfield); and,
WHEREAS, the Petitioners have demonstrated to the satisfaction, of. the
Board of County Commissioners of Garfield County:;.:.Colorado,` that the
proposed division does not fall within the -purposes of Pa;rt.1,: Article 28,
Title 30, Colorado Revised Statutes 1973, as amended, for the reason that
the division does not warrant: further subdivision review, and
WHEREAS, the Petitioners have demonstrated to the satisfaction of the.
Board of County Commissioners of Garfield County,: Colorador that there is
a reasonable probability of locating. domestic 'water oneach, of -said
tracts, that there is existing ingress and egress to said tracts,'thatthe
location of septic tanks will be permitted by the Colorado.Department of
Health, that the requested division is not part of an existing, or larger
development and does not fall within the general purposes and intent of
the subdivision regulations of the State of Colorado and the County of
Garfield, and should, therefore, be exempted from the definition of the
terms "subdivision" and "subdivided land" ,as set forth in C.R.S. 1973,
30-28-101 (10) (a). -(d), as amended

NOW THEREFORE, BE IT RESOLVED that the division of the above described
tracts "A"..and "B"_from the above described: 20.3.6. acre tract :is hereby
exempted from such definitions and said tract may be .divided into said
tracts "A" and "B" and may be conveyed in the".form of such tracts'"A" and
"B", all as is more fully described above and .that a copy of the
instrument or instruments of conveyance when recorded shal be filed with
this Resolution.

A tract of land situate in the SE 1/4 of the NE 1/4 of Section 33,
xbwnship 5 South, Ranee 90 West of the 6th Principal Meridian being
more particularly described as follows:
Beginning at a rebar and cap marking southwest corner of a tract of
land described in Hook 390 at Page 567 of the records of the Clerk and
Recorder of Garfield County, Colorado, Whence the east 1/4 corner of
said Set -tion 33 bears S 88.42'54" E 1319.67 feet; thence N 00'47'14" W
477.23 feet along the west lite of said tract, as w*i nted; thence
N 79'25'00" E 430.18 feet along a fences thence S 00'47'14" E 550.35
feet to a point on the south•1ine of said tract described in Book 390
