HomeMy WebLinkAbout2.0 BOCC Staff Report 11.02.1987REQUEST: APPLICANT: LOCATION: • • BOCC 11/02/87 PROJECT INFORMATION AND STAFF COMMENTS Exemption from the Definition of Subdivision Miles and Teresa Rippy A tract of land located in the SE 1/4 NE 1/4 Section 33, T5S, R9OW; approximately 2 miles east of New Castle, off of County Road 240 SITE DATA: The site consists of 20.36 acres WATER: Individual Well and Cistern SEWER: Individual Sewage Disposal System ACCESS: Existing and Proposed Private Drives off of County Road 240 EXISTING ZONING: ADJACENT ZONING: A/R/RD A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The site is located in District C, rural areas/minor environmental constraints, as designated on the Comprehensive Plan Management Districts Map. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is fairly level, consisting of portions of an old orchard. Improvements on the site include one single-family residence, several sheds or storage buildings, and parking areas for heavy equipment associated with a pre-existing non -conforming construction/excavating business. It is located in a rural portion of the County, with land uses in the vicinity primarily agriculture, single-family residential, and open space. B. Project Description: The applicants propose to divide the 20.36 acre site into two parcels approximately 5 acres and 15.36 acres in size. C. History: The 20.36 acre parcel has been in existence since 1967, based on deeds presented by the applicants. III. MAJOR ISSUES AND CONCERNS 1. Soil Conservation Service information on the site indicates only moderate limitations to single-family residences and individual sewage disposal systems, based on slopes and large stones. 2. The applicants have submitted an approved well permit for the proposed 5 acre lot. The existing residence currently utilizes a cistern for domestic water and proposes to continue such use. (See Page • • IV. SUGGESTED FINDINGS 1. That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at the meeting. 3. That for the above stated and other reasons, the proposed exemption is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION 1. That all representations of the applicants, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval. 2. That all shares of irrigation water associated with the property be divided proportionally between the lots and, that a plat note shall be included on the Exemption Plat stating, "That all irrigation ditches and ditch easements on the site shall be recognized and maintained as existing and in place." 3. That the applicants shall apply for and receive a driveway access permit for the 5 acre lot, as required by the Garfield County Road and Bridge Department. A copy of said permit shall be submitted to the Planning office. 4. Darrell Sorensen of Specialty Drilling and Well Service is currently drilling a test hole. 9-22-87 This well would only be used for a house on the 5 acre parcel. The current dwellings on the 20.36 acres use a cistern that has been in use for 28 plus years. They will continue using the cistern. Sewage Disposal: A septic system that would meet Garfield County requirements would be the method of sewage disposal.
