In response to your October 13, 2003 letter requesting further documentation for our
Special Use Permit, I am providing the following information:
Regarding Item #1: I have, today, faxed Rob Goodwin, at the Carbondale Rural Fire
Protection District, a request for help with providing you the information you need. I
have also left a voice mail request that he contact me, as well. I will provide this
information as soon as possible, after speaking with Rob.
Regarding Item #2: The 120 sq. foot shed has, as of this date, been partially dismantled.
Our current schedule is that it will be relocated from this property in December 2003.
I hope this information is helpful, and I will continue to pursue the help of Rob Goodwin
in addressing your request for documentation on Item #1. Please call or write if there is

I have met with Mr. Skip Ackerman and his employees this past year regarding fire mitigation
planning for the facility. We have covered various aspects of fire safety including fire apparatus
access, wildfire hazards, limiting the size of slash piles, location of fire extinguishers, fuel
storage, and development of a water supply for fire suppression. They have been very receptive
to suggestions and T am satisfied with the fire safety planning for their facility.
1 recently inspected the fuel storage at the facility. The storage consist of two 500 gallon
elevated horizontal fuel storage tanks along with portable fuel containers and portable containers
of hydraulic and lubricating oils. All of the tanks and containers arturt"-' a steel containment
dike. The storage of the flammable and combustible liquids meets the requirements of the
Uniform Fire Code, Article 79 — Flammable and Combustible Liquids.

I have reviewed the information you provided to our office with respect to the Special
Use Permit. Prior to the issuance of the actual Special Use Permit the following items
need to be addressed:
1. Rob Goodwin of the Carbondale and Rural Fire Protection District, to date, has
not contacted me as mentioned in your fax date October 1, 2003. As part of your
SUP approval, a fire mitigation plan for the property shall be signed off by the
District.
In addition, documentation shall be provided with respect to the fuel storage
✓tanks. Also, the method of storage of the gas and diesel, and the method of
containment shall spillage occur shall meet State and Local requirements. Please
provide something in writing addressing these issues.
/2. Please provide in writing the status of the removal of the 120 square foot shed.
Once these items are addressed, the Special Use Permit will be issued.

NOISE STUDY MEMO -
ACKERMAN HANDCRAFTED LOG HOMES YARD

As requested by the Garfield County Planning and Zoning Department, Ackerman
Handcrafted Log Homes investigated whether we were operating within the
guidelines of the State Statute for Noise Abatement. The following is an outline of
what we discovered:
We started out by downloading the State of Colorado Noise Abatement Statutes
#25-12-102 and #25-12-103. After reviewing the articles, I contacted The Division of
Colorado Department of Public Health and Environment for some help with
understanding the statute, and was referred to Bob Jorgenson of the Air Pollution
Control Division. After reviewing the definitions of Residential and Light Industrial
Zones, Bob determined that our yard should be considered a Light Industrial Zone
(25-12-102(5)), even though we are zoned ARR; and more importantly, that "In all
sound level measurements, consideration shall be given to the effect of the ambient
noise level created by the encompassing noise of the environment from all sources at
the time and place of such sound level measurement" (25-12-103(9)). However, no
one at the Health/Environment Department could give me any formula for
determining such consideration. Bob Jorgenson also noted that the State Noise
Abatement Statute is severely outdated, and that there is no regulation or enforcement
of it going on in the state that he is aware of.
Next, we purchased a standard sound level meter that measures sound levels in
decibels measured on the "A" scale. (25-12-102(2)). We conducted tests every half
hour, on September 30, 2003 from 11:30 AM to 5:30 PM, October 1, 2003 from 7:00
AM to 5:30 PM, and on October 2, 2003 from 7:00 AM to 12:30 PM. We had our
full crew working in the yard for the first two days, and a limited crew the third day.
The measurements were taken by our Yard Manager, Mike Reichert, at three different
locations within 25' of our property line. The measurement locations were adjacent
to the work areas. Although there was a lot of "quiet work" taking place, at various
times we had chainsaws in operations, and our three pieces of machinery running
intermittently. Those would be an electric band saw mill, a diesel powered crane, and
a diesel powered truck with a mounted log loader.

Our readings while tools and machinery were in operation were from below 50db.
(not measurable) to 66db. This measurement included the traffic noise generated
from County Road 100. As mentioned above, there was a lot of quiet work, such as
hewing and carving during the entire test period. And during these quiet times, we
measured the ambient sound, which was primarily from the county road. These
readings were from below 50db with no traffic, up to 72db with heavy traffic. Most
of the traffic readings were in the upper 60's(db).
According to the state statute, in a Light Industrial Zone (as defined by the
articles), we are allowed 70db(A) from 7:00 AM to the next 7:00 PM. For a
Residential Zone the allowable levels would be 55db(A). "In the hours between 7:00
a_m. and the next 7:00 p.m., the noise levels permitted... may be increased by ten
db(A) for a period of not to exceed fifteen minutes in any one-hour period. (25-12-
103(2)).
Summary:
Given the fact that (1.) our sound measurements while tools and equipment were
running was in the range of below 50db(A) to 66db(A), and (2.) the ambient noise,
while no work was going on was in the range of 50db(A) to 72db(A), and (3.) the
information I got from the State Noise Abatement Statute and Bob Jorgenson of the
Department of Public Health and Environment; I believe that Ackerman
Handcrafted Log Homes is operating within the guidelines of the State Statute for
Noise Abatement.
If, at any time in the future, it comes to our attention that we may not be operating
within those guidelines, we will certainly takes steps to mitigate any excessive noise.

Here are the Well Permit and Test Iievort for our well. Rob Goodwin of the
Carbondale Fire Department was here yesterday to inspect our Fuel Containment
Structure. He said he would contact you, and provide you with what you need.
We are working on a noise study, but arc having a difficult time translating the
State Statute for noise abatement, which is 22 years old. I have been in contact with the
State Department of Health and Environment, and they are even having a hard time
interpreting it. We are trying to fare out how the existing sounds of the area, such as
the highway noise, is affecting our sound meter readings, and how to factor that in. We
have ac:aally had higher meter readings from the County Road traffic than some of the
readings in our yard while we are working.
I will try and come up with a report by tomorrow of some sort for you.

I just received your inquiry regarding the status of our compliance with the
conditions of approval for our Special Use Permit. I must admit that things are moving a
little slower than I had expected; but we have been picking away at the conditions
throughout this year. Here is my status report relating to items "3." Thru "9." on
Resolution No. 2002-100, dated November 12, 2002:
3. Although I have not seen the Garco Weed Management Plan, we do routinely cut
weeds and thistles throughout the level area of our yard.
4. We have removed the log office from the railroad corridor, and plan to remove the
shed by the end of this year. I have had an onsite discussion with Michael Hernes of
RFTA, and he is aware of our efforts to comply. We seem to have a good working
relationsip.
5. We did close on the property in February of this year. Ownership is held in the name
of Ackerman Land Limited Liability Company.
6. We have recently applied for a building permit for a new 660 square foot office. We
have no plans at this time for any additional buildings.
7. We have no exterior lighting at this time.
8.
a. The 320 square foot office has been removed from the property. We are in
negotiations with a potential buyer to move the 120 square foot shed off of the
property also. If we cannot negotiate a sale soon, we will remove the shed
ourselves by December 1 of this year.
b. We did obtain a domestic well permit (#245829) on November 15, 2002. We had
a well drilled in April of this year, and will be using it to service our new office,
which we have recently submitted a building permit application for. The well did
test out at 15 gallons per minute.
c. We have recently applied for an ISDS permit, along with our building permit for
the new office. It has been recommended by Andy Schwaller that, given the high
water table and the low volume of wastewater that we will produce, a vault
system would be the most appropriate system for us. We are in the process of
designing a vault system based on systems that have already been approved by the
building department.

d. We did take some sound meter readings last fall, and didn't see any problems.
However, the next time we are in full production at the yard, we intend to take
daily meter readings and keep a log. We had been told by another log builder that
our band saw mill would be the noisiest piece of equipment because of it's high
pitch. We did replace that mill with a new electric mill in December of last year
that is much quieter.
e. We were unable to find any official state and local requirements for storage of
gas and diesel fuel. Everyone we spoke to referred us to another agency. What
we were told, however, by just about everyone we spoke to, including a
Carbondale Fire Department official, is that we needed a containment device that
would hold a large percentage of our total fuel storage capacity if there was a
spill. We did have a steel bin made that the tanks and stands are set in. My yard
manager, who is on vacation right now, has the specs on that. We will provide
that information when we submit our conditions in total.
f. We have had several meetings and discussions with Bill Gavette of the
Carbondale Fire Dept. in the past year regarding a fire mitigation plan. We have
taken all of his recommendations into effect by having operable fire extinguishers
strategically place in our work area and equipment. We also discuss fire issues at
our weekly safety meetings. And we will be adding an all season water valve,
with a hose, serviced by our new well in our work area. I will document this with
our other conditions.
9. Our only dust issue is when the prevailing winds blow strongly from the West.
However, upon numerous observations of this, the dust never leaves our property
since there is wide band of thick vegetation on the east end of our work site. I
will include this statement when we submit all of our documents in total.
Our estimated time frame for submitting documents that prove that we have met all of
the conditions will be to have this accomplished by December 1, 2003. Upon
reviewing this information, if you have any questions, comments, concerns, or advice,
please give me a call.

staff report on the Ackerman Handcrafted Log Homes special use permit. This letter is
offered in response to the issues raised in your report and hopefully will expedite
discussions during the public hearing on Monday; October 14, 2002.
Staff Report Page 2 — The staff report identifies hours of operation as "7:00 AM to 6:00
PM, Monday through Sunday." The special use permit application identifies the
same hours but from Monday through Saturday not Sunday.
Staff Report Page 2 Paragraph C — The structures on the property were constructed
after January I, 1973. Mr. Ackerman will work with the County Building
Department to obtain the appropriate permits applicable to structures on the
property. This process will he initiated as soon as possible.
Staff Report Page 4 Wastewater — Mr. Ackerman has submitted an application for a
well permit on the property. He will also work with the County Building
Department to secure an individual sewage disposal system permit (1SDS) for the
property. We request that the county approve a June 30, 2003 deadline for
completion of well and septic system installation as a condition of the special use
permit. Mr. Ackerman intends to secure financing and complete the purchase of the
property upon approval of the special use permit by the county. Purchase of the
property is expected to be completed in January 2003.
Staff Report Page 4 Weeds — Mr. Ackerman currently manages weeds on the property
on an ongoing basis. Weed management includes regular cutting of all noxious
weeds and cutting in the late summer/early fall to prevent propagation by seed.
Staff Report Pages 5, 7, 8 and 10 referencing compliance with Federal, State and
County laws, regulations and standards pertaining to vapor, glare, smoke,
dust, other emanations, noise, heat, glare, radiation, fumes and water pollution
— The staff recommends that Mr. Ackerman shall show compliance with applicable
laws "in the event of potential violations". The applicant requests that this language
be clarified and modified to state "upon receipt of a legitimate allegation of a

Staff Report Page 6 Railroad Right-of-way License — Mr. Ackerman has obtained a
"Consent to Assignment of Private Way License" dated April 8, 2002 from the
Roaring Fork Transportation Authority signed by Mr. Michael Hermes — Director of
Properties. This document certifies the willingness of the Roaring Fork
Transportation Authority to transfer "a non-exclusive right to use the private way
under the license for access to the property" to Mr. Ackerman upon conveyance of
the real property. A copy of this assignment is attached to this correspondence.
Staff Report Page 8 Fuel Storage — Mr. Ackerman is working with the Carbondale and
Rural Fire Protection District on proper fuel storage and containment. It is
anticipated that the fuel containers will be placed in a location recommended by the
fire district and a spill containment vessel will be constructed to prevent any spills
or leakage from contacting the ground. Mr. Ackerman is waiting for a response
from the fire district. It is requested that the special use permit be conditioned to
require completion of this work by December 31, 2002.
Staff Report Page 12 Conditions — Mr. Ackerman request that the special use permit be
issued conditionally upon compliance with the various requirements by dates certain
identified in this letter. Additionally, it is requested that the conditions related to
compliance with various emissions, noise, glare etc. be based upon receipt by the
county of a complaint of an alleged violation prior to Mr. Ackerman's
demonstration of compliance with the applicable law. The standard of a "potential
violation" does not provide a legal or objective basis from which proof of
compliance must be initiated.

Thank you for the land use application for a special use permit recently submitted to this office
on behalf of Skip Ackerman and Rex Coffman. An initial review of the application has been
conducted and the application has been found to be technically non-compliant at this point in
time. As a result, the application has been temporarily suspended from the review process until
the following issues are addressed:
1. Per our conversation on August 2, 2001, you had indicated that you were going to work
with Mr. Coffman to address the matter of the number of principal dwelling unit per 35
acres with respect to the subject property in its entirety. As we had discussed, a single
family residence is a use by right on 35 acre parcels. However, this use by right is
allowed on a legally created parcel, recorded with a deed.
According to County regulations, we are unable to process the request for the proposed
dwelling unit, until the acquisition of the 35 acres by Mr. Ackerman is completed and a
deed for the property and a recorded site plan of the 35 acres is submitted to this office.
Or, Mr. Coffman may create a 35 acre parcel himself and a copy of the recorded deed

As 1 begin to work on meeting the conditions of our Special Use Permit, an issue
has arisen regarding our two existing structures that the County has asked me to obtain
building permits for.
Both structures have only temporary foundations, and are encroaching on the
RFTA Corridor. With these factors in mind, plus the SUP condition of having a
permanent toilet, well, and septic system by June 30, 2003, I have come to the conclusion
that it makes more sense to tear down the existing structures and install a modular office
in a different location on our property.
Since we will be closing on the purchase of the property in January or February of
2003, and we cannot put in a well and septic system until after that takes place, I ask that
you consider the following request:
Allow us to continue using our office and shed without a building permit until we
can tear down or move those structures to another location, which will happen before
June 30, 2003. If we decide to move our office or shed to another location on the
property, we agree to obtain a building permit_ This will give us enough time to do some
important site planning, and make a smooth transition from our existing office to a new
one.
Your consideration in this matter will be greatly appreciated. Please give me a

present proof of publication and mailing at the hearing. Pursuant to Section 9.03.04(1-3) of the
Garfield County Zoning Resolution, notice for the hearing shall be given as follows:
(1) Notice by publication, including the name of the applicant, description of the subject lot, a
description of the proposed use and nature of the hearing, and the date, time and place for
the hearing shall be given once in a newspaper of general circulation in that portion of the
County in which the subject property is located at least thirty (30) but not more than sixty
(60) days prior to the date of such hearing, and proof of publication shall be presented at
hearing by the applicant.
(2) Notice by mail, containing information as described under paragraph (1) above, shall be
mailed to all owners of record as shown in the County Assessor's Office of lots within two
hundred feet (200') of the subject lot and to all owners of mineral interest in the subject
property at least thirty (30) but not more than sixty (60) days prior to such hearing time by
certified -return receipt mail, and receipts shall be -presented at the hearing by the applicant.
The site shall be posted such that the notice is clearly and conspicuously visible from a
public right-of-way, with notice signs provided by the Planning Department. The posting
must take place at least thirty (30) but not more than sixty (60) days prior to the hearing date
and is the sole responsibility of the applicant to post the notice, and ensure that if remains
posted until and during the date of the hearing.
