WHEREAS, ANN C. ROBINSON has petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption under C.R.S. 106-2-33(3)(d) (1963
as amended) for the division of a 92 acre tract into 2 tracts of 1.43 acres and
90.57 acres, more or less, with said 1.43 acre tract more particularly described
as follows:
A parcel of land situated in Lot. 4 of Section 19, Township 5
South, Range 92 West of the Sixth Principal Meridian, County
of Garfield, State of Colorado, lying Westerly of the Easterly
line of said Lot 4, said parcel of land is described as follows:
Beginning at the Southeast Corner of said Lot 4 said point
being on the Southerly line of said Section 19, whence the
Witness Monument to the Southwest Corner of said Section 19
bears: N. 80038'17" W. 1370.16 feet; thence N. 89057'45" W.
along the Southern line of said Lot 4, 160 feet; thence N.
00004'59" W. 450 feet; thence S. 89057'45" E. 160 feet to a
point on the Easterly line of Lot 4; thence S. 00004'59" E.
along the Easterly line of Lot 4, 450 feet to point of
beginning.
The above descrih2d parcel of land contains 1.65 acres, more
or less.
The above described parcel of land is subject to a 60 foot
County Road right-of-way running all along the Southerly
line thereof containing 0.22 acres, more or less, leaving a
total of 1.43 acres, more or less.
WHEREAS, the Petitioner has shown to the satisfaction of the Board of County
Commissioners of Garfield County, Colorado, that they desire said exemption for
adding on to an adjoining residential tract, and that said exemption will not result
in any third party ownership; and
WHEREAS, Petitioner has demonstrated to the satisfaction of the Board that the
requested division is in accordance with the general purposes and intent of the
subdivision regulations of the State of Colorado and the County of Garfield, and
should therefore be exempted from the definition of the terms "subdivision" and
"subdivided land" as set forth in C.R.S. 106-2-33(3)(d) (1963 as amended);
NOW, THEREFORE, upon motion of 17, Jo lr`_' L seconded by
and carried, said 92 acre tract of land is hereby
exempted from such definition and transfer of said tract may be made by subdivision
into 2 tracts of 1.43 and 90.57 acres, more or less, all as is more fully described
above, and further that said exemption is conditioned upon the addition of the 1.43
acre tract to an adjoining residential tract of land so that no third party owner-
ship will be created. A copy of the instrument or instruments of conveyance when
recorded shall be filed with this Resolution.
