Brynildson, whose address is 1831 Railroad Ave. Rifle, Colorado 81650-3203 Operator: Ursa Operating Company LLC for Ursa Piceance LLC (successor in interest from Antero Resources Piceance Corporation), whose address is 1050 17th Street, Suite 2400, Denver, CO 80265 Property: See Exhibit A which by this reference is incorporated herein (the "Property") Effective Date: December 1, 2006 Summary; Owner and Operator's predecessor entered into that certain unrecorded "Surface Lease and Easement Agreement" governing Operator's right to enter upon, use, construct, install and maintain a water evaporation and loadout facility associated with oil and gas drilling and production operations from Owner's lands as well as other lands along with structures, pipelines, electric power lines, equipment, fixtures, appurtenances and other facilities necessary or convenient therefore to facilitate said operations, a Recording Memorandum providing constructive notice of this Surface Lease and Easement Agreement was fled with the clerk and recorder of Garfield County, Colorado under Reception Number 747686, and; Owner and Operator's predecessor did then modify and amend the Surface Lease and Easement Agreement via that certain unrecorded "First Amendment to Surface Lease and Easement Agreement", executed on March 12, 2008, but made effective for all purposes on December 1, 2006, which further clarified the rights and obligations of the Parties under this First Amendment to Surface Lease and Easement Agreement, and to provide for additional rights and easements to include among other items, the right to access additional lands of Owner for a water load -out facility and pipeline easements on lands more fully depicted on Exhibit "A" attached herein, and; Owner and Operator have since entered into that certain "Second Amendment to Surface Lease and Easement Agreement", executed on December 15, 2016, which, in addition to providing additional rights and easements to the Operator, extended the term of this agreement to fifteen (15) years and the maximum lease period to twenty (20) years from the Effective Date of December 1, 2006. This Memorandum is being executed by the Owner and Operator for the primary purpose of recording and thus advising all interested parties of the existence and validity of such First Amendment to Surface Lease and Easement Agreement and the Second Amendment to Surface Lease and Easement, the exact terms and conditions of which are more fully stated in the unrecorded instrument(s) on file with the Owner and Operator. This Memorandum of First and Second Amendment to Surface Lease and Easement Agreement shall constitute notice to all parties of the existence of said agreements as though it was described in total detail herein.
