HomeMy WebLinkAbout1.05 Existing Approved Resolution and Permit1111 IYi'II' 111117 iMlAIN.WYCL,I+WN NI�� �IIII Receptjor)#: 727166 07(0572007 10:29-27 AM B: 1946 P: 0182 Jean Alberico 1 of 4 Ree Fee:$@.00 Doe Fee: GARFIELD COUNTY CO STATE OF COLORADO ) )ss County of Garfield ) At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Plaza Building, in Glenwood Springs on Monday, the 4`h day of June, 2007: there were present: John Martin , Commissioner Chairman Larry McCown , Commissioner Tresi HouRt, _, Commissioner Don DeFord , County Attorney Jean Albirco , Clerk of the Board Ed Green Absent , County Manager when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2007-59 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT FOR PROCESSING, STORAGE AND MATERIAL HANDLING OF NATURAL RESOURCES ON A PROPERTY LOCATED ON COUNTY ROAD 315 OWNED BY SCOTT AND LINDA BRYNILDSON (PARCEL NO. 217919100511) WHEREAS, the Board of County Commissioners of Garfield County, Colorado, received a Special Use Permit (SUP) request for "PROCESSING, STORAGE AND MATERIAL HANDLING OF NATURAL RESOURCES" submitted by WAGON WHEEL CONSULTING to construct and operate a water treatment facility; and WHEREAS, the subject property contains approximately 328.48 acres, is located in the NW '/4 of the NW I/4, of Section 20 in Township 6 South, Range 92 West of the Oh PM and is practically located off of County Road 315in the Agriculture/Residential/Rural Density zone district; and WHEREAS, the Board of County Commissioners opened a public hearing on the 41h day of June, 2007 upon the question of whether the above-described SUP should be granted or denied, during which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said SUP; and WHEREAS, the Board of County Commissioners closed the public hearing on the millR KW111RIMM S.. IM11+ 1i 11111 Reception#: 727188 07,05,2007 50:29:27 QM B: 1945 P: 9183 Jean piberioo 2 of 4 Pec Fee:10.00 Doc Fee: GARFIELD COUNTY CO 41h day of June, 2007 to make a final decision; and WHEREAS, the Board of County Commissioners on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of facts: 1. That proper publication, public notice, and posting was provided as required by law for the hearings before the Board of County Commissioners. 2. That the public hearing before Board of County Commissioners was extensive and complete; all pertinent facts, matters and issues were submitted; and that all interested parties were heard at those hearings. 3. The proposed special use permit conforms to Sections 3.02.03, 5.03, and 5.03.07 and 5.03.08 of the Garfield County Zoning Resolution of 1978, as amended. 4. The proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County, NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that based on determination of facts set forth above, the SUP request for "Processing, Storage and Material Handling of Natural Resources" is approved with the following conditions: 1. That all representations of the Applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval unless explicitly altered by the Board; 2, The Applicant shall provide Garfield County with a revegetation security in the amount of $23,360; 3. Volume and Sound generated shall comply with the standards set forth in the Colorado Revised Statute at all times; 4. The Applicant shall comply with all performance standards identified in §5.03.08 of the Garfield County Zoning Resolution as amended; 5. The Applicant shall construct a driveway access apron as required by the Garfield County Road and Bridge Driveway Access Permit prior to the issuance of the Special Use Permit; 6. The proposed facility shall be limited to 132 daily trips (66 daily roundtrips) for all vehicles as represented in the application and traffic analysis; 7. The leak detection and recovery system shall inspected weekly, accurate records of these inspections shall be maintained and made available to 1IIIMR'�kViNNIX1,14i. A portable toilet facility shall be placed on-site for the comfort of employees; 9. All trucks hauling water from Antero's drilling activities west of County Road 346 shall utilize I-70 to access County Road 315; 10. All seed mixes shall be approved by Garfield County Vegetation Management; 11. All lighting associated with this use shall be directed downward and away from adjacent properties; 12. The proposed containment pond must maintain at a minimum two (2) feet of freeboard at all times; 13. The migratory bird and water fowl deterrent represented must be installed prior to operation of the proposed facility; 14. That the operation of the facility be done in accordance with all applicable federal, state, and local regulations governing the operation for this type of facility; 15. That the Applicant shall comply with the fire protection provisions included in the rules and regulations of the Colorado Oil and Gas Conservation Commission (COGCC) and the International Fire Code as the Code pertains to the operation of this facility. 16. If required the Applicant shall be responsible for obtaining any permits and improvements required by Colorado Department of Transportation as a result of traffic generated by the proposed use; 17. Wildlife perimeter fencing shall be constructed prior to operation of the proposed facility; 18. The Applicant shall construct perimeter fencing as represented in this public hearing before Garfield Board of County Commissioners; 19.
