SUBJECT: Extension Request for the Land Use Change Permit - Limited tmpact Review for
a Storage Facility and Major Temporary Employee Housing (File No. LIPA-8'l91

EXTENSION REQUEST
The Applicant's representative, Phil Vaughan of PVCMI, lnc., is requesting an extension of the 1
yeartimeframeto complete condition of approval#1in Resolution of Approval2_ gl-5-10,fora MajorTemporaryEmployeeHousingFacilitylocatedapproximately3@f
Debeque and 5 miles south of the Rio Blanco County line, in Township S Soutn, Range gZ West
of the 6th P.M.; Section 1: S%NW% and the NW%SW %; Section 2: STzN/2, N%SE%and Lots 7
and 8; Section 3: SE%NE% and Lots 5, 6 and 7; County of Garfield. State of Colorado. The
operator of the facility is identified as WPX Energy Rocky Mountain, LLC and the property owners
are Eva C. Uphoff Trust and Timothy James Uphoff.
The Land Use Change Permit application was approved with conditions on June-1111915 Section
4-101(HX1) of the Land Use and Development Code states that "Unless otherwise approved by
the decision maker, an Applicant has 1 year from the date of approval or Director's Determination
to satisfy any remaining conditions precedent to issuance of a Land Use Change permit". As
approved, the deadline for the Applicant to complete condition of approval #1 is June 8, 2016.
ln accordance with Section 4-101(l) of the Land Use and Development Code, the Applicant has
requested an extension of the expiration date. This Section states that "Extensions of 1 yeatnray
begrantedforallconditionalLandUseChangeapprovals,,.
Condition #1 identified in Resolution of Approval 2015-30 requires the following prior to issuance
of the Land Use Change Permit:
The Applicant shall improve fhe access road as proposed to meet Secfion 7-107,
"Semi-Primitive" standards prior to issuance of the Land Use Change Permit. The
Applicant shall provide evidence that the roadway has been upgraded and meets
the standards set forth in Section 7-107. This evidence shall be reviewed by the
Gaiield County Community Development Department and the County Contract
Engineer.
A copy of the extension request submitted by the Applicant's representative is attached with this
memo. The request was submitted in a timely fashion and meets the requirements of Section
4-101(l) for extension of conditional approval.
BACKGROUND
The Applicant is conditionally approved for a I .5 acre Maior Tempo ousing facility
and Storage area called Trail Ridge within a S$J8-acre-parcel The parcel already has a graded
one acre area which will need to be expanded by about a half-acre to accommodate the housing
and storage facilities.
The facility is conditionally approved in a very remote location with grazing and oil and gas
activities as the only nearby land uses. The Applicant has represented that the nearest hotels are
an approximately 2.5 hour drive from the drilling rigs in this area.
According to the Application, the Trail Ridge Employee Housing Facility is to consist of the
following:
A. 24 person, 6 unit side-by-side housing facility
B. 10,000 gallon potable water skid
C. On-site wastewater treatment system
D. Diesel-fired electrical generator skid
E. Refrigerator and Freezer skids
F. Laydown yard and 60'wide x 125' long building for storage of drilling equipment,
hydraulic fracturing equipment, pipe, excavation equipment, maintenance tools and
snow-moving equipment.
G. Gravel parking areas and circulation areas for employees and deliveries
The traffic study as submitted states that the site will generate 2 vehicle trips per day (one round
trip) for the Temporary Employee Housing Facility. Supplemental materials indicate that 2 vehicle
trips per day (one round trip) for the storage facility is also anticipated.
RECOMMENDATION
Staff supports approval of the extension request for an additional year to complete the condition
of approval as requested by the Applicant. Should the Board approve a 1 year extension, the
new expiration date to complete condition of approval #1 would be June 8, 2017. Subject to
direction and a motion by the Board, Staff will prepare an appropriate resolution for the Board's
consideration.

Please consider this letter a request to the Board of County Commissioners to extend the
attached Resolution No.20l5-20 from June 8,2016 to June 8,2017. This resolution is
the conditional approval of a Major Temporary Housing Facility for up to 24 persons and
a laydown yard known as the WPX Trail Ridge Employee Houiing unA Storu!. Faciliry.
The pending ownership change of WPX Energy and current naturat gas prices have
delayed the construction of this project.
The Garfield use Regulations section 4-l0l-H notes the following:
