HILTON AND RANCH I\IVESTMENT CORPORATION WHEREAS, Gene R. Hilton and Ranch fnvestment Corporationhave filed a petition with the'Board of County Commissionersof Garfield. county requesti-ng a zone district amendment torezone portions of Lots B, 9, L2, SE/4SW/4 of Sect,ion 4,Lot 10 of Section 5 and NI,V/4NE/4 of Section g, Township 6south, Range 91 lilest, in Garfield County, from Agricultural-/Residentj-al,/Rura1 Densit.y and Agricultural/fndustrial ZoneDistricts, !o Plagned_U_nit Developmen! Zqne District and. for -apProval of*9!ae.-.p1an of Wood landlng Planned. Unit Development,hereinafter referred to as the ',development"; and. ' WHEREAS, publichearingswere held by this Board onthe 5th and l8t,h of August, and. the 6th of October, 1980, and the Board has personally visited the site and travelledthe af fected, :iighwa;*s; and WIIEREAS, based on the evidence, testimony, exhibits,study of the General Plan for the unincorporated area of the County, comments of the Garfield County Planning Department, comments of public cfficj-als and. agencies, comments from allinterested parties and perscnal observations of the Board.,this Board. f i-nds as follows: 1. That proper publication and. public notice wasprovided as required by law for the hearing before the Board; 2. That +-he hearing before the Board. was extensive andcomplete, that all pertinent facts, matters and issues weresubmitted and that all interested parties were heard at thathearing; 3. That, during the public hearing process, several t' substantial modifications were made to the p1an, upon whichmodifications the approval of the application d.epends; 4. That the Garfield County Planning Commission has reconimended to this Board that the requested rezoni-ng and.planr dS mod,ified through the 8th of September, 1980, beapproved, provided that certain conditions be compried with; 5. That the proposed l-and use will be compatible withexisting and permitted land uses in all directioni, exceptthat present roaos serving the site are presently inadequateto bear the additional traffic which would be generated bythe proposed development which deficiency may be susceptibleof resolution by negotiation between the appricants and theBoard; 6. That for the above-stated and other reasons,approval of the proposed deve'lopment, the proposed zoningand proposed planr dS modified, is in the best interest ofthe health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield county, if certainconditions contained herein are complied with;. q. ! i I I l i i " 7. That the traffic problerns related to County Road 335 , which is the only highway serring the subject property, are sufficiently serious that, if improvements necessary to provide safe travel are not assured, the Board, in the interests of public safety, would be required to cleny the requested zone. clistrict amendment and to disapprove the subject Planned Unit Development plan; 8. That Garfield County has insufficient funds provide for the required road improvements, that there presently no evidence that additional development will in any location which would contribute significantly to occur the need for the road improvements required by the requested Planned Unit Development plan, and that therefore the requested Planned Unit Development plan aPpears to be soleIy responsible for and associated with the road. improvements which will be necessitated for County Road 335 i 9. That, other than in the foregoing particulars, the requested zone change amendment and plan approval are in general in conformity with the General Plan for Garfield. County, Colorado, and meet all'requj-rements of the Zoning Resotution of Garfield County, and further than the requested Planned Unit Development is suitable and appropriate for the subject property considering the location, conditj-on and circurnstances of said property, and that the proposed amendment i-mplements the purposes and meets the standards and, requirements of the Planned Unit Development provisions of Garfield County Zoninqr Resolution, provided that certain conditicns contained herein be ccmplieC with ryOW, TIIEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado: Section 1. That the peii-.ion of Gene R. Hj-lto- and Ranch Itvestment Corporation for a zone change from Agricu'l- tural/Residential,/Rura1 Density and. Agricultural,/Industrial Zone Districts co Planned Unit Developn,:nt Zone Dj.strict for the foregoing described. unincorporated area of Garfield CountY, and for approval of the Plan of Wood. Landing Planned Unit De- velopment, may be approved only upon the resolution of traffic problems related to County Road 335, presentJ-y serving the subject property, and upon negotiation of an agreement between the applicants and the Board providing for the resolution of such d.ifficulty at no expense to Garfiel-d Countyr on or before the 5th day of January, 1981, upon which occasicn this Board will approve the requested zone district map amendment and Planned Unit Development p1an, uPon the following conditions: €1. Any plat approved. as a part of Wood, Land.ing Planned, Unit Deveiopment (hereinafter the "development") sha1l substan- tially comply with the sketch plan submitted. to the Board on the 6th of October, 1980; b. The phasing of the d.evelopment shalL assure that impact on the neighborhood be limited to the extent thatpublic improvements and servj-ces may properly deal with such impact i c. The applicants shall.provide a fire station site, buiLding space, 3/4 ton tiuck with a "drop-in" unit and other equipment to the Silt-Nerv Castle Fire Protection Dis-trict (estimated cost in 1980 $18,000), which station would provide needed fire protection south of the ColoradoRiver necessitated by the developmenti d. Section 2. That upon the Boardrs determination thatll,asatisEc-toryreso1utionofthetrafficprobIemhasbeen reached, the Board shall authorize the requested amendment *of -the zgne=-district map affecting the subject property and qp*pJ_oving the Planned Unit Development PIan,.but, if the Board determj-nes that the aforementioned traffic problem may not be resolved without the expendj-ture of public funds,the Board sha11 take appropri-ate action to deny the requested'zone district amendrnent and to disapprove the Planned Unit Development plan Section 3.
