A tract of land located in Parts of
Section 4, T65, R9IW; more
pracEically described as a tract of
land located approximately one ( I )mile southwest of New Castle, off
of county Road 335.
I. PROPOSAL DESCRIPTION
In October of 1980, by Resolution No. 80-258, the Woods Landing P.U.D.
was approved by the County. The P.U.D. would have a maximum of 317
residential lots and two mulEipurpose commercial Iots on the
approximately 91.0 acres of land included in the P. U. D. As a
condition of approval r the developer, Gene R. Hilton and Ranch
Investment Corporation, were required to agree to making improvements
to County Road 335 to alleviate traffic problems that would result
from the development of the project. An agreement to that effect was
signed in January of 1981.Since that time, there has been no
requests for extension of time to complete the project or any
subdivision applications .
II. MAJOR ISSUES AND CONCERNS
A. Zoning: Section 4.09.01 of the Garfield County zoning Resolution
6ffi9'7 8 , as amended, states that " the appl icant must begin
development of the P.U.D. within one year from the time of its
final zone change approval, provided, however, that the P.U.D.
may be developed in stages.' The only acLivity to occur since
the final zone change approval was the road improvement
agreement. Since January of 1981, there is no record of
continued activity. To revoke the P. U.D. approval, it is
necessary for the County to go through the rezoning process. The
Board of County Commissioners has scheduled a public hearing for
10:00 A. M. , April 20 , 1987.
III. SUGGESTED FINDINGS
1. That the Garfield County Board of County Commissioners referred
the proposed zone district text amendment to the Garfield County
Planning Commission for review and recommendation;
2. That Section 4.09.01 of the Garfield County Zoning Resolution of
I978r ds amended, requires a developer to begin development of ap.U.D. within one (1) year of the final zone change approval;
3. That no development activity on the Woods Landing P.U.D. has
occurred since the final zone change approval in October of 1980,
other than an agreement to perform road improvements in January
of 1981.
4. That for the above stated and other reasons, a zone district
amendment changing the zoning of property known as the Woods
f,anding P.U.D. to Agricultural/Residential/RuraI Density, is in
the best interest of the health, safeLy, morals, order,
convenience, prosperity and welfare of the citizens of Garfield
CountY.
IV. RECOMMENDATIONffinningCommissionrecommendtotheBoardofcounty
Commissioners that the property known as the Woods Landing P.U.D. be
rezoned to Agricultural,/Residential,/RuraI Density.
