practically described as a tract of
land located approximately one (1)
mile southwest of New Castle, off
of County Road 335.
PROPOSAL DESCRIPTION
In October of 1980, by Resolution No. 80-258, the Woods Landing P.U.D.
*"s approved by ifre- County. The P.U.D. would have a maximum of 317
resialirtiat lots and two multi-purpose commercial lots on the
approximately 91.0 acres of land included in the P.U.D. As a
ciirAition oi approval, the developer, Gene R. Hilton and Ranch
Investment Corpoiation, were required to agree to making improvements
to County noaa ggS to alleviate traffic problems that would result
from the development of the project. An agreement to that effect was
signed in January of I981.Since that time, there has been no
requests for extension of time to complete the project or any
subdivision aPPlications .
II. MA.JOR ISSUES AND CONCERNS
Zoning: Section 4.09.01 of the Garfield County Zoning Resolution
offS'Zg r ds amended, states that 'the applicant must begin
development of the P.U.D. within one year from the time of its
final ione change approval, provided, however, that the P.U.D.
may be developed in stages.' Section 4.09.02 states that 'If the
applicant doel not comply with the time limits imposed by the
pi-eceding subsection, the County Commissioners shall review the
ir.u.o. and may revoke approval for the uncompleted portion of the
P.U.D., or require the P.U.D. to be amendedr Qt extend the time
for completion of the P.U.D.i
Pl.anninq Commission Comments: On ApriI 8, I987, the Planning

III . SUGGESTED FINDINGS
That the proPer publication and public notice was provided
required by law for the hearing before Garfield County Board
County Commissioners;
That the hearing before the Board was extensive and complete,
that alI pertinent, facts, matters and issues were submitted and
that all lnterested parties $rere heard at that hearingi
3. That the Garfield County Planning Commission has reviewed the
proposed rezoning and made a recommendation to the Board of
County Commissioners;
That Section 4.09.0I of the Garfield County zoning Resolution of
1978r ds amended, requires a developer to begin development of a
P.U.D. within one (1) year of the final zone change approval;

5. That no development activity on the Woods Landing p.U.D. hasoccurred since the final zone change approval in October of 1980,other than an agreement to perform road improvements in Januaryof 1981 i
6. That for the above stated and other reasons, a one year extensionof time to begin development of property known as the WoodsLanding P.U.D., is in the best interest of the health, safety,morals, order , convenience, prosperity and welfare of thecitizens of Garfield County.
IV. RECOMMENDATION
