Adequate and complete information will prevent delays in the plan review process. Reviewing a plan and the discovery that required information has not been provided by the applicant may result in the delay of the permit issuance and in proceeding with building construction. The owner or contractor may be required to provide this information before the plan review may proceed. This causes delays because other plans that are in line for review may be given attention before the new information may be reviewed after it has been provided to the Building Department. Please review this document to determine if you have enough information to design your project and provide adequate information to facilitate a plan review. If you do not, it may be helpful to obtain a book titled "Dwelling Construction under the Uniform Building Code". This book is available to you through this department at our cost. Also, please consider using a design professional for assistance in your design and a construction professional for construction of your project. To provide for a more understandable plan in order to determine compliance with the building, plumbing and mechanical codes, applicants are requested to review the following check list prior to and during design. Applicants are require to indicate appropriately and to submit the completed check list at time of application for a permit. Access to the site is through a shared driveway with one neighbor, off of State Hwy. 133. III. MAJOR ISSUES AND CONCERNS 1. Home occupation is defined as "any use for gain or support carried on as an accessory use within a dwelling or in a building accessory thereto, wherein such use would not create the appearance or impact of a commercial activity. The only other performance standards or parameters addressing home occupations are found in Section 5.03 of the Zoning Resolution. (1) Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Environmental Health Officer shall either be in place or shall be constructed in conjunction with the proposed use; (2) Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use; (3) Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences or Landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character 2. In the past, a variety of activities have been approved as home occupation Conditional Use Permits. These activities include art studios, professional offices, catering kitchen, beauty shop, snowmobile repair and electrical contractor's facility. 3. Based on the operative definition, the issue to be considered is whether the applicant's use would "create the appearance or impact of a commercial activity." Staffs interpretation is that the aspects of the operation which give "the appearance or impact of a commercial activity" are that the operation, if contained entirely within the proposed building should not conflict with this definition. 4. Water/Sewer: This application states that the proposed sewage disposal will be the existing ISDS. It may be necessary to expand the existing system to accommodate the additional flows that will result from the proposed commissary. It will be necessary to have an evaluation of the existing system done to determine if the capacity is adequate to treat the additional flows. This will need to be submitted to the Planning Department prior to the approval of the permit. The applicants state that the Town of Carbondale is willing to provide domestic water for the proposed use. Confirmation of that will need to be provided in a letter to the Planning Department prior to the issuance of the conditional use permit.
