We have received no response to our request for engineering information to be submitted. It is a violation of State of Colorado and Garfield County statutes to build or occupy a residential dwelling and to install an individual sewerage disposal system without proper permits and inspections. Please be advised that the provisions of the Garfield County Zoning Resolution of 1978, as amended, and Section 30-28-124 of the Colorado Revised Statutes, as amended, provide that it is unlawful to use any building, structure, or land in violation of any county zoning resolution duly adopted by the Board of County Commissioners. Any person, firm, or corporation found to have violated such zoning resolutions is guilty of a misdemeanor and, upon conviction, can be punished by a fine of not more than $100.00 or by imprisonment in the County Jail for 10 days, or by both fine and imprisonment. Each day can be considered a separate violation. The County also has civil legal remedies available to it, including the initiation of legal proceedings to obtain injunction or abatement of any unlawful use of land in violation of the County Zoning Resolution. If communication with this office to initiate corrective action regarding the above alleged violations is not received within 30 days of the receipt of this letter, the Building and Planning Department will turn all information over to the County Attorneys office for possible legal action. Your cooperation in this matter will be appreciated in the interest of avoiding the necessity of having to litigate this issue. Adequate and complete information will prevent delays in the plan review process. Reviewing a plan and the discovery that required information has not been provided by the applicant may result in the delay of the permit issuance and in proceeding with building construction. The owner or contractor may be required to provide this information before the plan review may proceed. This causes delays because other plans that are in line for review may be given attention before the new information may be reviewed after it has been provided to the Building Department. Please review this document to determine if you have enough information to design your project and provide adequate information to facilitate a plan review. If you do not, it may be helpful to obtain a book titled "Dwelling construction under the Uniform Building Code. This book is available to you through this department at our cost. Also, please consider using a design professional for assistance in your design and a construction professional for construction of your project.
