The following items are required by Garfield County for a final inspection:
1. A final Electrical Inspection from the Colorado State Electrical Inspector,
2. Permanent address assigned by Garfield County Building Department posted where readily
visible from access road;
3. A finished roof, a lockable house, complete exterior siding, exterior doors and windows
installed, a complete kitchen with cabinets, a sink with hot & cold running water, non-absorbent
kitchen floor coverings, counter tops and finished walls, ready for stove and refrigerator, all
necessary plumbing.;
4. A complete bathroom, with wash bowl, tub or shower, toilet stool, hot and cold running.

5 All steps outside or inside over three (3) steps must have handrails, guard rails on balconies or
decks over 30' high constructed to all 1994 LBC requirements;
6. Outside grading done to where water will detour away from the building;
7 Exceptions to the outside steps, decks and grading may be made upon the demonstration of
extenuating circumstances. i.e. weather: but a Certificate of Occupancy will not be issued until ail
the required items are completed and a final inspection made.

Donna Nystrom
On site May 7, 1997 at the owners request to review structural implications of the new
windows and the front entry stairs and handrail. S K Peightal Engineers has not performed an
exhaustive review of this structure and only the following items were reviewed.
Item 1: The existing structure is a single story house which appears to be about 20 years
old. The original structure was constructed with pre-engineered trusses which appear to span
between the exterior walls. For this reason the interior partitions were assumed to be non-
structural and not reviewed. However there were no indications that the existing interior
partitions had been altered. The owner has installed new vinyl siding and a metal roof. The
siding appears to be installed over the original siding. The metal roof appears to be installed
over the original roof sheathing. This would indicate that the changes made were non-
structural.
Item 2: The window headers appear to be 3-2x10 typically. The worst case loading is the
window in the bedroom which has a 9'-0 rough opening. This condition is acceptable for an
assumed 40 psf snow load, which is the Garfield County minimum, provided the header is
constructed of Douglas Fir Larch #2.
Item 3: The existing front entry stair has several shrinkage cracks and the handrail has been
constructed of oriented -strand board. We recommend that this stair be removed and a new stair
be constructed as indicated on our drawings Si -S3.
The above represents our report of events noted and items discussed, and will be relied upon as
true and correct by all parties unless notified within 5 working days of receipt.

Dear Dr. Nystrom;
As a result of complaints and a review of outstanding building permits and individual sewage
disposal system permits, it appears,that construction activity may be occurring and an
unapproved pit privy is located on your property, without the appropriate permits. This
property is identified as Parcel No. 2463 021 02 016 in the records of the County Assessor's
Office. By this letter, you are being notified that any construction that is done without the
appropriate building permit is a violation of the Garfield County Building code and the use of
a pit privy not meeting state standards and approved by the Board of Health is a violation of
the ISDS Regulations.
It is the responsibility of the property owner to apply to the Building Department for the
applicable building permit and to request the required inspections after the permit is issued..
Without a final inspection, the County Building Department cannot issue a Certificate of
Occupancy, which may be required by a lending institution, prior to approving a loan.
Additionally, a building occupied without the appropriate final inspections may not be covered
by certain insurance coverages.
Please be advised that the provisions of the Garfield County Building Code, as amended, and
Section 30-28-209 of the Colorado Revised Statutes (CRS), as amended, provide that it is
unlawful to erect, construct, reconstruct, alter or use any building or structure in violation of
the County Building Code Resolution, or amendment, duly adopted by the Board of County
Commissioners. Any person, firm, or corporation found to have violated such building codes
is guilty of a misdemeanor and, upon conviction, can be punished by a fine of not more than
$100 or by imprisonment in the County Jail for 10 days, or by both fine and imprisonment.
Each day can be considered a separate violation. The County also has civil legal remedies
available to it, including the initiation of legal proceedings to obtain the injunction or
abatement of any unlawful erection, construction, reconstruction, alteration or use of a
building or structure in violation of the County Building Code Resolution.

The Garfield County Health Officer may issue an order to cease and desist from the use
of any system which is found by the Health Officer not to be functioning in compliance with
Article 10 of Title 25, C.R.S. 1973 and the Colorado Department of Health, Guidelines for
Individual Sewage Disposal Systems adopted by Garfield County. If a cease and desist order
is issued, the owner or occupant of the property will be given a reasonable period of time, not
to exceed thirty (30) days, to bring the system into compliance or eliminate the health hazard.
The owner or occupant will be ordered to cease and desist from the use of the system(s) after
the previously noted time period has expired, if the system is not in compliance. A cease and
desist order issued by the Health Officer may be appealed to the Garfield County District
Court if a petition is filed not later than ten (10) days after the order is issued.
Within 15 days of the receipt of this letter, you need to contact the County Building
Department to initiate corrective action. If you do not contact this office within the time
period noted, the next course of action would be to turn over all information to the County
Attorney's office for legal action. It is our preference to resolve this type of issue without
going to court, but your cooperation is needed to avoid litigation.

Due to recent remarks from trustees concerning the A.C.R.E. and
T.K.K. subdivisions, I feel that there is not a clear understanding of
what the real facts are on this issue. I obtained the following
information, from Garfield County Records, to help assess what the
real risk potentials of development are:
1. The vast majority of lots in the two subdivisions are owned by the
Carbondale Corp. and the Considine family. Together they own
approx. 330 of 485 total lots, and are the "majority owners". (The
county owns 10 lots and are the second largest holder.)
2. Due to strict covenances, Te Ke Ki can virtually not be developed
without support from the "majority owners".
3. Therefore the total # of new homes that can be built between the
two subdivisions, barring development by the "majority owners", is
approx. 50.
4. If the "majority owners" wish to develop the two subdivisions,
and make a significant investment in infrastructure, both
subdivisions can be totally built out.(approx. 475 private lots)
am more than willing to help limit development impacts on the
east mesa. However, any effort to conserve the area has to be led by
at least one large land owner to be effective. Therefore, I will
support any large scale effort to protect the East Mesa by including
the properties I own up their in any large conservation easement.
The above information was obtained from the Garfield County
assessors office, they have this information on file. Please let me
know if you don't agree with any of it.
