*In researching my mineral interests at the Garfield County Clerk and Recorders Office, I could not find a
mineral deed severing the mineral estate from the surface estate. In review of the title commitment
issued by Land Title Guarantee Company, file no.: GWS63008317-4,and dated 02-25-2014, there is no
mention of the mineral estate being reserved or severed. I did find a “PAID-UP OIL AND GAS LEASE”,
reception no. 783910, dated February 15th, 2010 between Gregorio Delgado and Antero Resources
Piceance Corp., indicating Gregorio Delgado was the owner of the mineral estate at that time.
I purchased my property from Gregorio Delgado in March, 2014 as recorded in the Warranty Deed,
reception no. 847248. This was a short sale and by law, the mineral interest could not be reserved or
severed by the Grantor. Therefore, I conclude I am the owner of the mineral estate that lies under my
property.
