Authority. This application for a Building Permit must be signed by the Owner of the property, described above, or
an authorized agent. If the signature below is not that of the Owner, a separate letter of authority, signed by the
Owner, must be provided with this Application.
Legal Access. A Building Permit cannot be issued without proof of legal and adequate access to the property for
purposes of inspections by the Building Division.
Other Permits. Multiple separate permits may be required: (1) State Electrical Permit, (2) County OWTS Permit,
(3) another permit required for use on the property identified above, e.g. State or County Highway/ Road Access or
a State Wastewater Discharge Permit.
Void Permit. A Building Permit becomes null and void if the work authorized is not commenced within 180 days of
the date of issuance and if work is suspended or abandoned for a period of 180 days after commencement.

data submitted by me or on my behalf (submittals), based upon my certification as to accuracy. Assuming
completeness of the submittals and approval of this Application, a Building Permit will be issued granting
permission to me, as Owner, to construct the structure(s) and facilities detailed on the submittals reviewed by the
Building Division. In consideration of the issuance of the Building Permit, I agree that I and my agents will comply
with provisions of any federal, state or local law regulating the work and the Garfield County Building Code, OWTS
regulations and applicable land use regulations (County Regulation(s)). I acknowledge that the Building Permit
may be suspended or revoked, upon notice from the County, if the location, construction or use of the structure(s)
and facility(ies), described above, are not in compliance with County Regulation(s) or any other applicable law.
I hereby grant permission to the Building Division to enter the property, described above, to inspect the work. I
further acknowledge that the issuance of the Building Permit does not prevent the Building Official from: (1)
requiring the correction of errors in the submittals, if any, discovered after issuance ; or (2) stopping construction
or use of the structure(s) or facility(ies) if such is in violation of County Regulation(s) or any other applicable law.
Review of this Application, including submittals, and inspections of the work by the Building Division do not
constitute an acceptance of responsibility or liability by the County of errors, omissions or discrepancies. As the
Owner, I acknowledge that responsibility for compliance with federal, state and local laws and County Regulations
rest with me and my authorized agents, including without limitation my architect designer, engineer and/ or
builder.

CONDITIONS TO ALL PIPELINE GRADING AND INSTALLATION PERMITS
FOR GARFIELD COUNTY
1. All work to comply with ASME 831.8-2007 and manufacturers recommendations for steel
pipelines.
2. All work to comply with ASTM D2774 for pressure poly pipe installations and ASTM D2321 for
gravity flow poly pipe installations. Follow all manufacture's recommendations.
3. Minimum cover over all installations is 48 inches.
4. Properly compacted backfill is required between parallel pipes in a common trench. Provide
adequate space between the pipes to achieve adequate compaction.
5. The trench bottom should have stable (firm) soils and free of protruding rocks . A minimum of 4
inches of Class I bedding is required under poly pipe.
6. Compaction requirements are 85% standard Proctor for Class I and Class II backfill (including
padding), 90% standard Proctor for Class Ill backfill, and 95% standard Proctor for Class IVA soils
and for all backfill under and within 6 feet of roads. Maximum lifts of 12-inches for Class I, 8-
inches for Class 11, and 6-inches for all other classes . Compaction test are required every 200
feet until compaction practices meet these requirement. Compaction once established must be
spot checked every 400 ft. or when fill materials or processes changes.
7. Padding (shading) of all pipes is required a minimum of 24-inches around the pipe with 12-
inches of padding over the pipe. Padding particle size of no greater than 11/2 -inch for a 10-
inch to 15-inch diameter pipe. If the pipe is 16-inches or larger, the 2 inch maximum particle is
allowed.
Inspection Reports shall be completed to verify the above specifications. In addition the reports shall
show:
• Name of the inspector, date, time on site, and weather;
• A description of the work in progress;
• Summary of conversations with contractors/others;
• Summary of sampling and testing activities;
• Verification of pipe material, grade and alignment;
• Observation of pipe installation, placement of padding and backfill materials, and trench
excavation methods;
• Verification of proper pipe storage, handling, and installation procedures are followed;
• Copies of all pressure integrity, non destructive X-Ray and compaction test; and
• Pictures to document the construction.
Stormwater management plans require routine inspections during all phases of work every 14 days and
after a precipitation-related event.

The materials don't discuss the drainages that are to be crossed. Are they Waters of the U.S.? Are there
wetlands to consider?
Does Garfield County still have pipeline construction specifications? I looked briefly on-line but couldn't find
them. lf so, I think that the applicant should have them referred to on the plans.

2. The Applicant understands and agrees that Garfield County Resolution No. 98-09, as
amended, establishes a fee schedule for each type application, and the guidelines for the
administration of the fee structure.
3. The Applicant and the County agree that because ofthe size, nature or scope ofthe
proposed project, ¡t is not possible at this time to ascertain the full extent of the costs
involved in processing the application. The Applicant agrees to make payment of the Base
Fee, established for the Project, and to thereafter permit additional costs to be billed to the
Applicant. The Applicant agrees to make additional payments upon notification by the
County, when they are necessary, as costs are incurred
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the
consideration of an application or additional County staff time or expense not covered by
the Base Fee. lf actual recorded costs exceed the initial Base Fee, the Applicant shall pay
additional billings to the County to reimburse the County for the processing of the Project.
The Applicant acknowledges that all billing shall be paid prior to the final consideration by
the County of any Land Use Change or Division of Land.

To whom lt may concern: The Owner owns portions of the syrface of a tract of land described in the
attached Exhibit-A located ín Garfield County, Colorado, identified as a part of Battlement Mesa PUD,
hereinafter refened to as the "Property' and currently is in the process of developing the same for
residential and commercial uses; The Property is subject to a surface use agreement between a
predecessor of Elo<onMobil and a predecessor of Battlement Mesa Partners, LLC ('BMP') dated
becember 12, 1989 recorded at Reception Number 548481, Book 1139, Page 112in Garfield County,
Colorado ('BMP-E:a<onMobil SUA') which agreement reserved to ExxonMobil the right to use portions of
the property to develop its mineral interest underlying the Property._Operator n9!09 yatjO and subsisting
oil and'gas leasehold rights underlying portions of the Property from En<onMobil, Owner and other
parties, ãnd, as such has the right to reasonable use of the surface of the Prope,rty to explore for,
äevelop, and produce certain of ihe oil, gas and other hydrocarbons ("Oil and Gas') that underlíe the
prooeriv. Opêrator and Owner have entered into a separate surface use agreement dated effective
¡anlary 15, ä009 ("Surface Use Agreement") to set forth their understanding of the relative rights and
obligations of the Þarties concemihg operations on and development of the Property. The Parties'
Suri'ace Use Agreement provides for the coexistence and joint development of the surface estate and the

This noxious weed inventory and management plan was prepared at the request of Red Rock
Gathering Company for the proposed Battlement Mesa lnterconnect Pipelíne. Red Rock Gathering
Company, LLC (RRG), a subsidiary of Summit Midstream Partners, is proposing to construct
approximately 2,651feet (0.5 miles) of 16-inch diameter buried steel natural gas pipeline and related
aboveground facilities. The proposed Battlement Mesa lnterconnect Pipeline project is located in
Garfield County, Colorado, in Section L6, Township 7 South, Range 95 West (6th Principal Meridian).
The project area is at an elevation of approximately 6,000 feet'
Soiltypes are described by the NRCS (2015) as lldefonso stony loam, 6 to 25 percent slopes.
The proposed pipeline corridor follows existing pipelines, which were constructed by Encana Oil and
Gas (USA) lnc., and Red Rock Gathering in the past L0 years'
Both Garfield County's noxious weed listl and the State of Colorado's noxious weed list2 were utilized
for these survey efforts (see Appendix A and B). To summarize, our surveys found the following
State listed noxious weeds:

1.1. Description of AnalYsis Area
The proposed Right-of-Way (RoW) would be within a previously disturbed ROW area. Surrounding
the ROW, the vegetation is dominated by a community of mixed grasslands caused by the removal of
pinyon-juniper woodlands from a previous wildfire event. The western half of the alignment is on
private lands. Within these lands, the current ROW is dominated by crested wheatgrass (Agropyrum
cristotum), smooth brome (Bromus inermis\, cheatgrass (Anisøntha tectorum), western wheatgrass
(poscopyrum smithii), yellow sweetclover (Metitotus officinøtis), alfalfa (Medicogo satival, salsify
(Tragopogon dubius\, and widely scattered shrub species including fourwing saltbush lAtriplex
canesnens), rubber rabbitbrush (Chrysothamnus nauseosus), and a few individual sagebrush

(Artemisia tridentatol. On the eastern half of the ROW, the BLM lands were seeded with a more
native seed mix, and vegetation is dominated by western wheatgrass, rubber rabbitbrush,
cheatgrass, crescent milkvetch (Astragalus amphioxysl, indian ricegrass (Oryzopsis hymenoidesl,
broom snakeweed (Gutierrezìa sorothroel, curlycup gumweed (Grindelia fastigiatal, with bluebunch
wheatgrass lPseudoroegnerio spicota) being more common in areas protected from grazing (such as
in and around rock piles). The BLM lands were heavily grazed, so not all species were identifiable;
the early spring period also means that many other species were not yet up and were likely missed.
Other problematic plant species observed in the area, but not listed by the State of Colorado or
Garfield County, include clasping pepperweed, curlycup gumweed, prickly lettuce, Russian thistle,
salsify, yellow sweet clover, and tumble mustard. These species can make reclamation effort more
difficult.

Cheatgrass was widespread across both private and BLM lands; this is not surprising given cheatgrass
is the dominant grass species off the ROW, within
the burn area. Compared to the burn area'
cheatgrass on the ROW has much less cover.
The other common weed is redstem filaree; its
occurrence was widespread, but was dominant in
some small patches.
On BLM lands, chicory was widespread, but in
very low densities (average one individual plant
every 3O-feet or so). Because of its widespread
and low-density occurrence, this species was not
recorded with GPS.
On both BLM and private lands, there were small
patches of Russian knapweed; these patches were
relatively small (5-L0-feet in diameter), and fairly
widespread.
ln 201-5, WestWater Engineering conducted a noxious weed survey in the area for a 3O-foot pipeline
tie-in, using a 3g-meter buffer for noxious weed surveys, and a S0-meter buffer for sensitive plant
species. This tie-in was at the western end of the Battlement Mesa lnterconnect pipeline project
area, and onto the Tompkins pad. within these buffer areas they additionally documented bull

3. Noxrous Weeo MRn¡ReeuENT PLAN
As mandated by the Colorado Noxious Weed Act and the Colorado Oil and Gas Conservation Act (and
in conformance with BLM and U.S. Forest Service (USFS) National lnvasive Weed Strategies), an
operator shall control noxious weeds on lands they disturb during oil and gas exploration and
development, including well pads, facilities, pipelines, roads and any other disturbed areas on private
property (and on BLM and USFS lands).
To meet the requirements of the Colorado Noxious Weed Act, the operator shall conduct prescribed
management techniques for noxious weeds included on one of three State weed lists: List A -
designated for statewide eradication; List B - managed to prevent further spread and, for selected
species, designated for eradication in large areas; and List C - of more localized concern, but for
which the State will provide education, research, and biological control assistance to jurisdictions
that choose to manage the species. The current State list is available in Appendix A.
lf populations of List A species are present in the project area, every population shall be eradicated
prior to seed development. To stop the spread of List B species, populations of every species
designated for eradication in a county shall be eliminated prior to seed development.
Additionally, to meet reclamation objectives, the operator should eliminate or minimize those
noxious and invasive weeds designated as "undesirable species". Undesirable species include
redstem filaree and quackgrass, all List C species (e.g., halogeton [Hologeton glomerotus] and
cheatgrass lAnisontha tectoruml), and invasive species that commonly colonize disturbed or
reclaimed land and impede or prevent establishment of desirable species (e.g. kochia lKochia
sieversiana, K. ironico, K. scoparia] and Russian thistle lSalsolo australis, S. iberica, S. kalill.
Control of invasive species is a difficult task and requires on-going control measures. Care must be
taken to avoid negatively impacting desirable plant communities and inviting infestation by other
pioneer invaders. Weed management is best achieved by employing aggressive control early on, and
persistent control efforts over several growing seasons, including direct treatments, prevention
through best management practices, monitoring of treatment efficacy, and subsequent detection
efforts. Weed management is often limited to controlling existing infestations and prevention of
further infestations, rather than eradication, but through effective weed management practices
eradication can be possible in smallto medium sized weed populations.

RRG would utilize the following seed mix for reclamation on BLM lands; this mix may be modified by
BLM. Seeding in the late fall (e.g., mid-October) is best to provide for the most optimal reclamation
success and seed establishment. This mix is consistent with the current BLM seed mix guidance
document (Perkins 2014l,.
These rates are based on drill seeding (i.e., 60 PLS per square foot), but if the site is to be broadcast
seeded, and then double the seeding rate (120 PLS per square foot or lbs/acre). lf noxious weeds
appear to be an issue, then withholding seeding-in the Utah serviceberry and yarrow for one year to
allow for more effective weed management (spraying) would be recommended. Seeding with
natives should occur in the fall (mid-October)'

On private lands, the following mix has been provided to RRG for use:

Of note, this mix contains a hybrid of quackgrass (Elytrigia repensl x bluebunch wheatgrass
(Pseudoroegneria spicato). While this hybrid may be acceptable, quackgrass is a very undesirable species.
Also in this mix is the Arriba variety of western wheatgrass; the BLM has indicated that this variety can
become very aggressive and outcompete other native species.
