It appears from your comments that the proposed variance request for a roof -top sign is in lieu of the possibility of the applicant having a free - standing sign on that property. The Town of Carbondale has no problem with the County approving this variance with the understanding that this roof -top sign is in lieu of a free - standing sign. It is our policy to try to have attractive signs and preserve our viewplains; therefore, it would be in our interest to have this roof -top sign approved as opposed to the allowed free - standing alternative. I have not yet received the date for continuance of the Public Hearing that was scheduled for July 25, which was cancelled because of the failure to obtain a quorum. Site Description: the subject property is located adjacent to the Town of Carbondale, at the southwest corner of State Highway 82 and State Highway 133, formally the site of the Shamrock Station. The applicant is proposing to install a sign that would extend beyond the roof line by approximately five (5) feet. Total height from natural grade would be approximately fifteen (15) feet. Staff' notes that the code does not consider flat roofs, hence the variance request. The design of the proposed sign is shown on page jo III. MAJOR ISSUES AND CONCF,RNS 1.Section 5.07.12 of the Garfield County Sign Code allows the Board of Adjustment to grant a variance based on the following guidelines: A. It is the policy of the County to encourage aesthetically pleasing signs without substantial interference with the business to which the sign relates; B.Projected signs should not substantially obscure any part of another sign related to another use; C.Excessive large or tall signs should be avoided to prevent visual obstruction of the natural scenery within the County; D. Variances should not be granted which would allow any business use unfair advertising advantage over any other business use. E.If it is necessary or reasonable to grant a variance to the strict regulations of this chapter, the sign should be limited in size, height and location in conformance with the purpose of the sign. The application is not based on typical "hardships ", but rather the restriction imposed by the code's failure to consider non - pitched rooflines. Staff notes that the code currently would allow a thirty (30) foot freestanding sign, with 150 square foot of sign face. The current proposal is for a 96 square foot sign. The Garfield County Sign code is not as restrictive as the Town of Carbondale. Staff had discussions with Town staff, and concluded that the maximum allowed sign under the code would not fit with the existing signs in the vicinity, primarily due to height and scale. In short, the requested variance is a more acceptable alternative than the,requested variance. IV. SIICW ESTED FINDINGS 1.That the application for Variance was found to be consistent with the requirements and standards of Section 5.07.02 of the Garfield County Zoning Resolution of 1978, as amended. 2.That proper publication and public notice was provided as required for the public hearing before the Zoning Board of Adjustment. 3.That the public hearing before the Zoning Board of Adjustment was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at the meeting.
