PRACTICAL LOCATION: The site is located at 963 County Road 229 and 877 County
Road 229, Silt, CO 81652, approximately 1 miles west of the Town of Silt. The site is
located within Section 5, T6S, R92W.
TYPE OF APPLICATION: Amended Final Plat
ZONING: Rural (R)
I. GENERAL PROJECT DESCRIPTION
The Applicant is requesting an amended plat for Tract 17 of the Antlers Orchard
Development for consideration in conjunction with a boundary line adjustment with the
neighboring property to allow for a lot line adjustment. Tract 17 is owned by the
DiGuglielmo's and the adjoining property is owned by the Decherts.
The amended plat and boundary line adjustment will allow for the realignment of the lot
lines to convey an existing orchard area to the Decherts and convey an equal area of
pasture to the DiGuglielmo's. The mutual conveyances of property will in effect swap areas
approximately 0.28 acres in size between the ownerships. The net effect is that both lots
will remain the -same size (9.697 acres and 10.278 acres) with no reduction.
The Applicant represents that no nonconforming conditions will result from the amendment
and conveyances. No other changes to the properties are proposed
II. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS
The following Sections of the Garfield County Land Use and Development Code as
amended apply:

Final Plat
Section 4-103 Administrative Review Process and Section 4-101 Common Review
Procedures
Article 7, Divisions I, 11, and III as applicable
Boundary Line Adjustment Affidavit and related procedures from the Assessor's
Office
As a convenience outlined below is a list of information typically required for this type of
application:
�/➢ A narrative describing the request and related information.
Copy of the Application Form with signatures, payment of Fees and signed Payment
Agreement Form.
Proof of Ownership (title work or copy of a deed) and information on any lien
holders.
Names and mailing addresses of properties within 200 ft. of the subject properties.
Tract 17 and the metes and bounds adjacent property should be utilized for noticing
purposes. Mineral rights ownership for the two subject properties including mailing
addresses.
Authorization to represent from DiGuglielmo to Dechert as appropriate and/or
signatures on the Application form.
If owners intend to have a representative (Planner or Attorney) complete the
Application and processing then a letter of authorization is needed.
Copy of the Preapplication Summary needs to be submitted with the Application.
The Proposed Plat showing the existing and proposed lot lines, any easements
(including irrigation ditches) and rights-of-way and including all required certificates.
Improvement location information on the plat or separate documentation adequate to
confirm that no nonconforming conditions will result from the proposed plat
amendment.
The Application should include a copy of the current recorded plat for the Antlers
Orchard Development.
A Vicinity Map for use in the required public notice.
The request should be consistent with all applicable provisions of Article 7, Divisions
1, 11, and III as applicable. The Application should include at a minimum

representations that the amendment will not result in any changes to drainage,
access issues, will not affect utility services, and any other applicable Subdivision
and Article 7 topics.
The Application should include the Boundary Line Adjustment Affidavit and
supporting information (legal descriptions of the property being conveyed) as
required by the Assessor's Office.
III. REVIEW PROCESS
The review process shall following the steps contained in Table 5-103 and Section 4-103
for an Amended Final Plat and Administrative Review including:
➢ Pre -application meeting
➢ Submittal of Application (3 copies plus one on CD or USB Stick)
➢ Completeness Review and submittal of additional information as required
➢ Referrals are sent out including the Assessor's Office
➢ Date for the Director's Decision is set
➢ Public notice (15 days prior to the Director's Decision) is sent out by certified mail to
adjoin property owners within 200 ft. and certified return receipt requested to
mineral rights owners on the subject properties
➢ Staff reviews the Application and referral comments and prepares a report
➢ Director Decision
Y 10 day call up period
➢ Any conditions need to be met and the plat in a form ready for recording provided
within 90 days.
➢ Plat is reviewed, final edits completed and once all conditions have been met a
mylar is prepared.
➢ The mylar is circulated for signatures and once complete, the plat is placed on the
consent agenda for the Board of County Commissioners signature.
The Application submittal needs to include 3 hard copies of the entire Application and 1
Digital PDF Copy of the entire Application (on a CD or USB Stick). Both the paper and
digital copies should be split into individual sections. Please refer to this pre -application
summary for submittal requirements that are appropriate for your Application.

General Application Processing
Planner reviews case for completeness and sends to referral agencies for comments. The
case planner contacts applicant and sets up a site visit. Staff reviews application to
determine if it meets standards of review and makes a recommendation of approval,
approval with conditions, or denial to the Director of the Community Development
Department.

Letter of explanation for boundary line adjustment.
Clyde and Anna Dechert seek to amend a lot line between theirs
and a neighbors property so that an existing orchard is wholly
contained on the Dechert parcel. Subject site is two parcels, the 10
ac. Dechert meets and bounds site and the 10 ac. DiGuglielmo site
which is Lot 17 of the Antler's Orchard Plat. The amendment will
not change the lot size of either parcel. No compensation is offered
or accepted by either party.
Mineral rights on the Dechert property are owned by the Decherts.
Mineral rights on the Diguglielmo property are retained by Dale
Neffendorf as recorded in the attached records.
