GARFIELD COUNTY (hereinafter COUNTY) and
(hereinafter APPLICANT) agree as follows:

Z. APPLICANT understands and agrees that Garfield County Resolution No. 98-09, as-amended,
establishes a fee schedule for each type of subJivision or land use review applications, and the guidelines for
the administration of the fee structure.
3. APPLICANT and COLINTY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to urJrrt i, the full extent of the costs involved in processing the

Dear Mr. Lee and Mr. Price,
The ptrpose of this letter is to bring to your attention an issue that is of concern to the
Aspen Glen Design Review CommiJtee (DRC). The DRC reviewed and approved
several items pertaining to tle purchase of Lot B-4 including a reuse of the existing
garage,tlie future use 0f the properly after the home was demolished, minoi landscape
revisions, as well as a plat amendment to eliminate Lot B-4 and increase the size of Lots
B-3 and B-5.
It is standard protocol that the DRC review proposats to amend recorded plat documents.
As part of this review process, adjacent properry owners are notified of the proposal. The
DRC provides a recommendation to the Garfield County Board of County
Commissioners viathe Garfield County Building and Flanning Deparhent.
As was proposed to the DRC, Lot B-4 was to be eliminated and the lot divided between
Lot B-3 and B-5 increasing the size of the two lots. However, during the DRC review
altering the platted building envelopes was not identified to the DRC or initially in the
application submitted to the Garfield County Building and Planning.Deparhnent.
The DRC takes the recorded/platted building envelopes in Aspen Glen very seriously. It
is because the envelopes are recorded and any changes publically noticed tlrat have
helped us to avoid neighbor disputes as properties are developed. It has been the DRC's
philosophy that if development is within the b,uilding envelope then adjacent property
ownersiannot expect or argpe for a redesign in order to protect their views. Likewise if
a property owner proposes to alter the building envelope it is imporant for all affected

property owners to be notified of a potential change and given the opportunity to examine
how the change will impact their property.
Therefore, the DRC was frusffated when we realized that the Lot B-4 plat amendment to
merge with Lots B-3 and B-5 also altered the platted building envelopes and significantly
expanded the size of the building envelopes for Lot B-3 and B-5 without notice to the
DRC. All previous discussions focused on the elimination of the lot, the o1d house, the
reuse of thi garugeand the gazebo etc.
It is the DRC's intent to formally request reconsideration by Garfield County. The DRC
requests that you as a property owner in this matter join with the DRC to amend the plat
to create building.or.lop"r thut urc more commensurate withthe building envelopes in
Aspen Glen.
Specifically, we request that you have Brad Jordan draft new plats for each of your
properties, B-3 and B-5, including in both cases ttre added footage from the fonner lot B-
4. These newplats should showthe original B-3 and B-5 Building Envelopes, should
eliminate the old B-4 Building Envelope, and should delineate the areas that you
propose should be added to your respeCtive original envelopes. As we understand your
plans, these "areas to be added" should be limited to A) in the case of B-3, the area
sunonnding the original galrrge and new workshop/office addition, and B) in the case of
B-5, the mea surrounding the original gazebo structure near the river. These
proposed envelope additions should not connect to, or be contiguous with, your original-g-ior
B-5 envelopes.
These new plats should be submitted by Mr. Jordan, or by yotl to the DRC for review
and approval. Upon appioval, the DRCwill notify Garfield County, as per our usual -
procedure, that your new plats with revised Building Envelopes have been approved by
Aspen Glen. These revised plats maythen be submitted to the County.
I request that you each please confirm to me that you will submit revised plats to the

To all,
Attached i.s a letter that I received in the mail today from Aspen Glen DRC.
This has decomc a hot topic regarding the lot consolidation. As you will
see, they are requesting additional information and attempting to block any
futtre development on your parcels. I will be meeting with the County this
afternoon on another project and will confront the County on the
issue/threat that is brought forttr by the DRC. I feel that this is tuming
into a big power play on the DRC's part and that they axe over stepping
their boundaries on this issue. I may be wise to have this reviewed by your
prospective attorneys. In a nutshell, the DRC wants to have some assurance
that these properties cannot be developed any further, in the future. I
cannot imagine buying a piece of very valuable land and having the local
subdivision DRC tell me that I cannot develop it. Sounds to me like the DRC
is attempting to thwart any potential financiatgain in the merging of 3
lots into 2! Please advise.

Re: Aspen Glen Lot B-04 - Plat Amendment
Dear Fred,
The Aspen Glen Design Review Committee considered a proposed plat amendment for
Lot 8-04/0435 Diamond A Ranch Road West at their May 14, 2008 meeting. The
applican! Ashton Lee property owner of Lot B-03 also representing the owners of Lot B-
05, proposed to subdivide Lot B-04 adding each half to the adjacent properties, Lot B-03
and Lot B-05. The DRC understands that the applicants will seek a plat amendment to
extinguish one platted lot and increase the size of two other platted lots.
Once the plat amendment is complete, the applicant intends to demolish the existing
home but preserve the gazebo and the garage. It is also the intent of the applicants to
locate building envelopes around each of the preserved improvements.
If any future improvements are proposed for the adjusted properties a DRC review and
approval will be required. This would include demolition/construction management
piu*, renovation of tfr" property once the home is gone and arry removal ofvegetation on
the property. It is the DRC's opinion that any amendment to the plat and any conditions
of approval recommended by Garfield County should occur before any further DRC
review is to occur.
Adjacent neighbors were notified of the pending plat amendment and a notice sign was
posted on the property. There were no comments received regarding this proposal.
The DRC recommends approval of the plat amendment to divide Lot B-04 between Lot
B-03 and Lot B-05 and eliminate the building envelope on Lot B-04. This proposal
would remove a home that has fallen into disrepair and provide more open space in
Aspen Glen. However the DRC does not believe it is within their purview to make a

recommendation regarding the preservation or renovation of the gazebo or the
preservation of the four fireplaces that currently exist in the home on Lot B-04.
