After obtaining a copy of the recorded Statement of Authority from the County Clerk's office, it would appear that the submitted documentation satisfies the submittal requirements of the 2013 Land Use and Development Code (LUDC) and allows the process to proceed. The next step is to set a decision date, then to execute the notice requirements. A Director Decision date has been set for November-2Sr 2 December 2, 2013, at which time a decision will be issued on whether to approve, approve with conditions or deny the application. It is your responsibility as the Applicant to complete the required 30 -day public notice requirement. Please mail the attached Notice Form, certified mail with return receipt requested, to the adjacent properties within 200' of the subject lots (as included on the submitted list of owners within 200' of Lots B-6, B-7, B-8 and B-9. You must provide both proof of mailing and proof of receipt prior to the Director Determination on the application. The notice is required to be sent at least 30 days prior to the date of Director Determination (mailed by October -24-7-2013 at the latest). KCJiice An outline of the review process is provided: 1. The Director Decision is set for December 2, 2013; 2. You must send the Public notice by the end of the day on Friday November 1, 2013 in order to meet the minimum 30 day time requirement for notice; 3. A request will be sent for County Surveyor review and provide comments on the plat; 1 4. The planner will review the plat and provide comments on any required additions or modifications; 5. On December 2, 2013 the Director will issue the decision and notify both the applicant and the Board of County Commissioners (BOCC) of the decision. The BOCC has the ability to "call-up" the application for a public hearing. We are required to give the BOCC 10 days to review and determine if the application should be called -up for hearing (deadline December 12, 2013). Once the 10 day call-up period has passed (December 16th) and no call-up is requested, the mylar can be obtained from your surveyor and signatures obtained. Once all the required signatures are completed the Planner can schedule the plat for Board of County Commissioner signature. Be aware that the plat will not be able to be scheduled for Board signature in 2013. The last Board meeting in 2013 is December 16, 2013. Your signed mylar must be submitted to Community Development by the end of the day on Monday December 9, 2013 in order to be scheduled on the 16th. Diamond A Ranch Rd. Carbondale, CO 81623 Description of Request: To vacate the building envelope of Lot B-8 and distribute the area of Lot B-8 into the three adjacent lots. All persons affected by the proposed amendment are invited to comment regarding the application. You may state your views by letter, or you may call the Community Development Department at (970) 945-8212 regarding the application. The Director will give consideration to the comments of surrounding property owners, and others affected, in deciding whether to grant or deny the request. The application may be reviewed at the office of the Planning Department located at 108 8th Street, Suite 401, Garfield County Administration Building, Glenwood Springs, Colorado between the hours of 8:30 a.m. and 5:00 p.m., Monday through Friday. The Director will issue a decision on this application on Monday, December 2, 2013 therefore any comments to be considered must be received prior to that date.
