REQUEST Lot B8, a 1.696 -acre parcel, was purchased by three contiguous Aspen Glen lot owners with the intent to divide Lot B8 into three portions with each of those portions incorporated into the owners' lots. This results in the following changes: Original Size Proposed Size Increase in size Lot B6 1.388 -acres 1.614 -acres .226 -acres Lot B7 1.009 -acres 1.914 -acres .905 -acres Lot B8 1.696 -acres vacated -1.696-acres Lot B9 2.441 -acres 3.001 -acres .560 -acres The owners also request vacating the existing building envelope from Lot B8. B. APPLICABLE REGULATIONS The Amended Final Plat process contained in Section 5-305 of the 2013 Land Use and Development Code (LUDC) stipulates an Administrative review procedure, with the Plat being presented to the Board of County Commissioners for signature and recording in the Office of the Clerk and Recorder. Criteria for the review have been satisfied as listed below: 5-305 Review Criteria 1. Does not increase the number of lots; Staff Comment: This application does not increase the numbers of lots and is specifically requested to decrease the number of lots within the subdivision. 2. Does not result in a major relocation of a road or add 1 or more new roads; and Staff Comment: No new road or relocation of roads is proposed. 3. Will correct technical errors such as surveying or drafting errors. Staff Comment: This plat is not correcting technical errors. C. REFERRAL AGENCY COMMENTS 1. The County Surveyor has reviewed the proposed amended plat and provided comments to the applicant's surveyor. A condition of approval is recommended to assure that the comment is adequately addressed prior to signature of the plat. 2. The Aspen Glen Design Review Committee has reviewed the application and requested 1 that the builidng envelope on Lot B8 be vacated. The applicant has agreed to this and a revised plat submitted indicating that this has been adequaely addressed. D. RECOMMENDATION Staff recommends that the Director of Community Development approve the requested plat amendment with the following conditions: 1. That all review comments received from the Aspen Glen Homeowners Association, Community Development and the County Surveyor have been adequately addressed and the plat amended accordingly. 2. Prior to scheduling the plat for Board of County Commissioner signature, the applicant shall submit a mylar signed by all required entities except the Board of County Commissioners, Clerk & Recorder and County Surveyor. 3. Within 90 days of this determination the Amended Plat shall be signed by the Chairman of the Board of County Commissioners and recorded in the office of the Garfield County Clerk and Recorder. The Plat shall meet the minimum CRS standards for land survey plats, as required by Colorado state law, and approved by the County Surveyor. 4. The home owners of Lots B-6, B-7 and B-9 purchased the unimproved Lot B-8 to prevent future development. They intend to divide the property amongst themselves and add their portion to their existing properties. The amended plat shall extinguish the building envelope on Lot B-8. Amendments to the building envelopes of Lots B-6, B-7 and B-9 were not proposed as part of this plat amendment. 2. A copy of the recorded amended plat shall be provided to the Aspen Glen DRC. 3. The DRC did not consider vacation of utility easements as that is the responsibility of the property owner to ensure that those easements can be vacated based upon review by service providers. 4. Drainage easements are considered vacated by this plat amendment because the existing drainage pattern of Lot B-8 will not be affected by this plat amendment and drainage of the surrounding properties was considered at the time of their development.
