Culpepper Land and Cattle Company. Lot B-9, Aspen Glen, Filing l. Vacant lot with an approximate acreage of 2.441 acres. Blue Heron Road. PUD. L INTRODUCTION/DESCRIPTION OF TTIE PROPOSAL: The applicants, Culpepper Land and Cattle Company, are requesting a Plat Amendment to adjust the existing building envelope on the subject property. The amendment would increase the size of the building envelope by adding an additional section of approximately eighteen feet (18') by one hundred six feet (106) on the western boundary ofthe current building envelope as depicted in the submitted amended plat. The existing building envelope is currently partially within the one hundred (100) year flood plain as depicted on the submitted amended plat. The proposed amendment (addition) would be entirely within the existing one hundred (100) year flood plain as depicted on the submitted arnended plat. Thus, as a condition of approval of this request, prior to any development of the property within the 100 year floodplain, as depicted on the submitted map, the property owner must obtain a Floodplain Special Use Permit, as per Section 6:00 ofthe Garfield County ZoningResolution. In addition, a plat note must be included on the Amended Plat to be recorded which states, '?rior to any development on Lot B- 09, within the 100 year floodplain as depicted on this map, the properly owner of Lot B- 09 must obtain a Floodplain Special Use Permit, as per Section 6:00 of the Garfield County Zoning Resolution. ASPEN GLEN DESIGN REVIEW COMMTTEE A letter has been submitted from the Aspen Glen Design Review Committee (See application submittal), approving the proposed modification to the building envelope. ru. GEOTECHMCAL ISSUES: In a letter dated July 31, 2000, (See submittal application), HP Geotech comments on the geological conditions of the subject properly. Comments include, "Elevating the building area to mitigate the shallow groundwater condition and possibly the flood plain issues will probably be needed." These issues would be addressed during an application for a Floodplain Special Use Permit, which is being recommended as a condition of approval of this application. IV. RELATIONSHIP TO TI{E COMPREIIENSI\E PLAI.I This application appears to be in compliance with the Garfield County Comprehensive Plan of 1995, for Study Area 1, as amended. V. GARFIELD COUNTY ZONING RESOLUTION: The subject property is zoned PUD. This application appears to be in compliance with its PUD zoning. VI. ST]BDIVISIONREGIJLATIONS: 6:00 Amended and Corrected Plats 6:10 An amendment m6y be made to a recordedplat, if such arnendment does not inerease the number of subdivision lots or dwelling units, result in the major relocation ofa road or add new roads. This applied for Amended Plat does not increase the number of subdivision lots or dwelling units, and it does not result in the major relocation of a road or add new roads. Any proposed amended plat relocating two (2) or less property lines common to two properties, may be approved by the Board of County Commissioners at a public meeting. (ee-oe6) The proposed Amended Plat does not relocate any properly lines. This application appears to be in compliance with the Garfield County Subdivision Regulations of 1984, as amended. VII. OT}IER ISSUES: The applicant should be aware that any lien holders of the subject properly will have to sign the Amended Plat to be recorded. D( SUGGESTED FINDINGS: 1. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed Amended Plat is in the best interest ofthe health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield Cotrnty. 4. That the application is in conformance with the Garfield County Zoning Resolution of 1978, as amended. 5. That the application is in conformance with the Garfield County Subdivision Regulations of 1984, as amended. 6. That the application is in conformance with the Garfield County Comprehensive Plan of 1995, for Study Area 1, as amended. RECOMMENDATION Staff recommends APPROVAL of the applied for Amended Plat with the following conditions: 1. Prior to any development of the properly within the 100 year floodplain, as depicted on the submiued map, the properly owner must obtain a Floodplain Special Use Permit, as per Section 6:00 of the Garfield County Zoning Resolution. 2. A plat note must be placed on any Amended Plat for recording which states, '?rior to any development on lot B-09, within the 100 year floodplain as depicted on this map, the property owner of Lot B-09 must obtain a Floodplain Special Use Permit, as per Section 6:00 of the Garfield County Zonrng Resolution."
