PUD (Planned Unit Development) The subject property is approximately 1.69 acres (73,616 s.f.) I. DESCRIPTION OF THN PPOPOSAL: 1. Development Proposal: The Applicant proposes to amend an approved building envelope to accommodate a duplex unit approximately 2,900 square feet on each side, plus a two-car garage of approximately 500 square feet on each side. The Applicant is proposing to move the southern building envelope boundary approximately 20 feet from the approved location to coincide with the edge of the Glenwood Ditch Ease,ment. 2. Site Description: The Applicant noted that during the site development studies conducted on the subject parcel for a duplex development, the shape of the current building envelope resulted in an architectural configuration that is excessively linear. The Applicant asserted that this is inconsistent with the visual character and massing preferred by and hannonious with the architecture design guidelines of Aspen Glen. The subject property is flat and gently slopes toward the Roaring Fork River. 3. Applicability: Pursuant to Section 6:00 of the Subdivision Regulations, an amendme,nt may be made to a recorded plat, if such amendme,nt does not increase the number of subdivision lots or dwelling units, or result in a major relocation of a road or add new roads. II. REVIEW AGENCY AI\D OTHT',R COMMENTS: This application was not referred out for comments. m. REVIEW CRITERIA FOR AMENDED AI\D CORRECTION PLATS (SECTION 6:00) The Applicant asserted that the requested building e,nvelope expansion of the southwest boundary (river side) would permit the following design and development outcomes: Aspen Glen Lot D-( Amended Plat BOCC - 9/9/02 Page 2 1. Vehicular access within the building envelope: The Applicant noted that vehicular access is diffrcult and virtually impossible without ffaversing the existing utility easement. 2. Permits two more or less equal landscape enffy courts with workable garage access, tuming and vehicle radii. The entry court is "pinched" to nearly impossible by virtue of the very nalrow building envelope configuration at the easterly (up river) end. 3. Most important, the enlargement of the envelope permits the building massing to vary from a linear configuration, allowing architectural massing variety and human scale. The architectural guidelines require that "Large residences have at least three distinct masses visible in each building elevation." A test building configuration can be much less linear, can accommodate roof gable and pitch variations, and can improve the privacy and life style between two attached dwelling units. 4. The envelope change would permit development on the subject parcel to be further distanced from the adjacent parcel with better mutual privacy. Staffis of the opinion that the proposed building envelope amendment should not increase any off- site impacts to the adjacent lots. It appears that the proposed building envelope expansion will maintained the setback requirement for live streams. Pursuant to Section 5.05.02 of the Zoning Resolution, a setback of thirty (30) feet measured horizontally from and perpendicular to the high water mark on each side of any live stream shall be protected as greenbelt and maintained in conformation with the definition thereof, with the exception of diversionfacilities as an accessory to the approved use of the lot. av. oTmR 1. Aspe,n Glen Design Review Committee: Comments were received from the Aspen Glen Design Review Administrator, Keith Edquist, which are included with the application. Mr. Edquist indicated that the Design Review Committee felt that the proposed building e,nvelope changed on the subject property would be beneficial and they would support the change to the building envelope if approved by the County. Mr. Edquist noted that some governing documents of Aspen Glen would need to be amended. 2. A copy of a letter of opposition sent to Mr. Edquist on August 15,2002, from the owners of Lots D-3 and D-4, is attached to this memorandum. The owners of Lots D-3 and D-4 are opposed to the proposed building envelope a:nended for a number of reasons which are outlined in the letter. In general, the owners of Lots D-3 and D-4 feel that all the owners of the lots in Aspen Glen Subdivision were aware of all building, zoning and other regulatory requirements at the time of purchase of the lots and amending the e'nvelope would set precedence for other property owners. 3. Due to concenm with respect to geologic hazards, i.e. sink-holes, throughout the Aspe,n Glenn subdivision, staffrequested that documentation be provided by a certified geologist prior to signing of the amended plat that there are no geologic hazards within the area of the proposed building envelope expansion. The Applicant's representative, Cottle Graybeal Yaw, provided a letter sent to Hepworth- Pawlack Geotechnical, Inc. (attached), requesting that a soils test be conducted in the area of the building envelope expansion. Aspen Glen Lot D-I Amended Plat BOCC - 9/9/02 Page 3 (L: V. STAFF FIITIDINGS: 1. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 2. That the application has met the requirements, standards and/or criteria, of the Garfield County Subdivision Resolution of 1984, Section 6:00, Amended Plat. VI. RECOMMEI\IDATION: Staffrecommends APPROVAL of the Aspen Glen, Lot D-1 Amended Plat application to amend the building envelope as requested with the following conditions: 1. That all representations of the Applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval; 2. The plat shall be titled "Amended Final Plat of (subdivision name)". Within 90 days of approval, the Amended Final Plat shall be signed and dated by the County Surveyor, than signed and dated by the Chainnan of the Board and recorded in the Clerk and Recorder's Office of Garfreld County. The Amended Final Plat shall meet the minimum CRS standards for land survey plats, as required by Colorado state law, and approved by the County Surveyor and shall include, at a minimum, the information outlined in Section 5:22 of the Garfield County Subdivision Regulations. 3. The Applicant shall comply with the governing documents of Aspen Glen as they pertain to the subject property.
