Lot 021, Aspen Glen Filing 1, located in the South 1/2 of Section 20, Township 7 South,
Range 88 West, of the 6th P.M., as shown on the Aspen Glen Filing 1 Plat, Reception No.
476330, recorded April 6, 1995 in the Garfield County records.
That said owner has caused the said real property to be laid and surveyed as the First
Amended Final Plat: A Resubdivision of lot 021, Filing l, Aspen Glen, a subdivision of a
port of Garfield County, Colorado.
That said owner does hereby dedicate and set apart all of the streets and roads as shown
on the accompanying plot to the use of the public forever, and hereby dedicate to the
Public Utilities those portions of so id real properly which ore labeled as utility easements
on the accompanying plat as perpetual easements for the installation and maintenance
of utilities, irrigation and drainage facilities, including but not limited to electric lines, gas
lines, telephone lines; together with the right to trim interfering trees and brush; with
perpetual right of ingress and egress for installation and rnointenonce of such lines. Such
easements and rights shall be utilized in a reasonable and prudent manner.
That all expense for sireet paving or improvements shall be furnished by the seller or
purchaser, not by the County of Ga1·field.

6. Each lot is subiect to private utility easements for the purpose of maintaining existing private utilities that
are constructed across one lot, yet provide service fo the other lot. Said eosements ore lo be ten {l O) feel wide,
five (5) feet on each side of the private utilities as constructed and in p!oce. Private utilities consist of the
following: domestic water service pipeline, sanitary sewer service pipeline, natural gas pipeline, underground
electrical, tefecommunicotion, and coble television service lines. Said easements are not depicted hereon.

A) Aspen Glen Filing No. 1 is a part of Aspen Glen P.U.D. approved June 29, 1992 by the Board of County
Commissioners of Garfield County. The terms and conditions applicable to the Aspen Glen P.U.D. are set forth
in the resolution of t11e County Commissioners recorded on June 29, 1992 as Reception No. 436262 in Book
835 ot Page 305 of the records of the Garfield County Clerk and Recorder.
B) Aspen Glen Filing No. 1 is subject to the terms of Declaration of Covenants, Conditions, and Restrictions
for Aspen Glen recorded in Book __ at Page __ .
C) Certain building locations may be subjed to geologic and hydraulic hazards. All structures shall require
the submittal of on engineering report addressing soils and geology conditions, foundation design and
drainage prepared by a registered professional engineer All site development, including building construction,
shall be conducted in accordance with engineer's stipulations.
D) 1) No open hearth so!id~fuel burning fireplaces will be allowed anywhere within Aspen Glen with the
exception of four (4) fireplaces in the clubhouse ond fireplaces currently in place in exisiing residences.
2) All dwelling units will be crilqwed an unrestricted number of natural gas burning ftrep~aces or

3) All dwelling units will be of lowed no more thon one new wood burning stove as defined by C.R.S.

E) Lots may be located within the 100 year floodplain. Lots within regulated floodplain are subject to the
regulations of Section 6: Floodplains of the Garfield County Zoning Resolution
f} Only one dog is allowed for each dwelling unit.
G) Lots D 1 through D45 are duplex Lots and may be further subdivided at a future date.
H) River waters are subject to a River Recreation and Boating Easement for the benefit of the public.
I) Dead or dying cottonwood trees within the Open Space/River Parks shall be preserved for cavity nesters
and perches used by roptors/eagles. If such trees present a hazard, the Homeowner's Association may remove
such trees at its discretion.
