All three of the proposed Amended Final Plats have been o(ecutd bythe owners of the lots, by the owners' surveyor, and by me, as attorney for the owners. The Amended Final Plats are: 1. An Amended Final Plat of Lot D7, fupen Glen Filing No. l. Lot D7 is owned by Lany Burng D.O. he has signed the plat and I have also attached a letter from Dr. Burns authorizing the Plat Amendment and explaining its purposes. Essentially the purposes of the Amended Plat are to relocate the building envelope on the lot and to depict on the plat the easement for the Glenwood Dtch as the ditch has actually been constructed and is now in place and in use. It is my understanding that the Board of County Commissioners has preViously reviewed and approved a blue line ofthis amended plat and the mylar now needs to be signed and recorded. 2. An Amended Final Plat of Lot Fl3, Aspen Glen Filing No. 1. This lot is owned by Philip J. Byrne and the Amended Plat has been signed by him and is submitted on his behalf The purpose of this amendment is to increase the size of the building envelope on the lot. The original building envelope is undersized and inconsistent with building envelopes on adjacent lots. There are no geologrc hazards on this lot and no conflicting easementg so we believe it was simply an error that the original building envelope was made so small. The Board of County Commissioners has not prwiously seen this request, so I believe it needs to be submitted for approval, and then signed and recorded ifapproval is granted. 3. An Amended Final Plat of Lot A9, Aspen Glen Filing No. l. This lot is still owned by Aspen Glen Golf Company and the proposed Amended Final Plat also requests an increase in the size ofthe building envelope. In this case, however, the original building envelope was undersized t Mark Bean Ivlay 15, 1997 Page2 because of a conflict with an apparent wetland on the lot. I have attached a letter from the Army Corps. of Engineers that verifies "a small portion of the total wetland previously verified by us no longer meets the criteria for wetlands." Based upon that modified wetland delineatioq we believe the reason forthe small building envelope no longer exists and we request that the building envelope be enlarged to the size shown on the enclosed plat. The increased building envelope is consistent with all applicable setbacks, easements, etc. Again, the Board of County Commissioners has not prwiously seen this request, so I believe it needs to be submitted for approval, and then signed and recorded if approval is granted. We request that these matters be brought to the Board's attention at the first opportunity. A representative of fupen Glen and I can be present at such meeting if you believe it appropriate. I hereby authorize Aspen Glen Golf Company to make application for an amendment to the Final Plat of Lot D-7, Aspen Glen Filing No. l, which requests the following changes to Lot D-7. l. Elimination of the Glenwood Ditch easement on the southerly side of Lot D-7. 2. Redesignation ofthe thirty (30) foot easement along the property line between Lot D-7 and D-6 from a utility easement to a Glenwood Ditch easement, 3. Creation of a new easement for the Glenwood Ditch along the northerly border of Lot D-7, which easement shall extend an additional20 feet into Lot D-7 and be parallelto the existing utility easement between Lot D-7 and Lot D-8. 4. Relocation of the building envelope on Lot D-7, inits same size and shape. to the south a sufficient distance so that it does not encroach on the new Glenwood Ditch easement along the northerly boundary oflot D-7. By so authorizing Aspen Glen Golf Company to make the foregoing Application to Amend the Final Plat for Lot D-7,it is my further intention to request Garfield County to approve the aforesaid Application for Amendment to the Final Plat of Lot D-7, Aspen Glen Filing No. l.
