RE: Aspen Glen Filing 1, Lot E-8 Amended Plat (File No. FPAA-10-15-8391)
Dear Chad:
This letter is in response to the Amended Plat request for Lot E-8. Filing 1 of the
Aspen Glen Subdivision that you submitted on behalf of John Walker. The
property is located at 60 Puma Drive and is known by Assessor's Parcel No. 2393-
203-01-008.
The Application has been reviewed in accordance with the Administrative Review
procedures contained in the Land Use and Development Code as amended. Said
provisions require a decision by the Director of the Community Development
Department on whether to approve, approve with conditions, or deny the request.
The Director's Decision is hereby issued approving your Application for an
Amended Final Plat of Lot E-8, Filing 1 of the Aspen Glen Subdivision including a
finding that the application meets the requirements of the Garfield County Land
Use and Development Code as amended including the Amended Plat Review
Criteria contained in Section 5-305 and subject to the following conditions:
1. That all representations of the Applicant contained in the Application
submittals shall be conditions of approval unless specifically amended or modified
by the conditions contained herein.
2. All requirements from the County Surveyor shall be met prior to submittal of
the plat for final execution.
3. The Plat including signature blocks and plat notes shall be subject to final
review and approval by the County Attorney's Office prior to submittal of the plat
for final execution,
4. The Plat shall include a plat note indicating the purpose of the amended plat
to be an adjustment to the building envelope on Lot E-8. A plat note shall also be
required indicating that all previous plat notes set forth on the Final Plat of Aspen
Glen Filing No, 1, as recorded as Reception No. 467330 and any amendments
thereto shall remain in effect.
5. The Amended Plat shall be subject to compliance with the Aspen Glen
Homeowners Association approval letter dated 10/14/15 which letter shall be
attached as an exhibit to the Director's Decision.
6. Prior to execution of the amended plat, the Applicant shall provide
documentation from a licensed surveyor that all eave overhangs for the existing
structure will be located within the amended building envelope.
The Land Use and Development Code requires notification to the Board of County
Commissioners for their review and potential call-up of the Director's Decision.
The Board review is for a period of 10 calendar days commencing on the date of
the Director's Decision. The call-up period shall expire on December 5th. The
Amended Final Plat will be scheduled on the Board of County Commissioner's
consent agenda after expiration of the call-up period and once all conditions of
approval have been satisfied including editing of the plat and acquisition of all
necessary signatures. Please note that you will have 90 days from the date of
approval to submit a plat suitable for recording. Extensions of this time period may
be requested prior to the expiration of the original time limit.

amended plat.

Re: Building Envelope Adjustment Lot E-08/60 Puma

This letter is to confirm that the Aspen Glen Design Review Committee has reviewed the
proposed plat amendment to adjust the building envelope for Lot E-08 (60 Puma) at a
meeting October 7, 2015. The proposed adjustment was considered to accommodate the
recently completed home that was built erroneously outside of the platted building
envelope due to a survey error. This error was only discovered when the buyer of the
home requested a new survey as part of their due diligence.
The DRC approved the adjustment and recommends approval to the Garfield County
Board of County Commissioners with the following conditions:
1. The adjustment shall mimic the footprint of the home on the west side of the
building envelope. including eaves and other items that are required by Garfield
County to be contained within the building envelope.
2. A copy of the recorded amended plat shall be provided to the Aspen Glen DRC.
3. The DRC has only approved the plat amendment. Any further improvements to
property shall be submitted for DRC review and approval.
The DRC noticed property owners within the vicinity of the property and no objections
were noted. In fact, the adjacent property owner most affected, stated in a letter to the
DRC that she supports the plat amendment because there is ample vegetation between the
two homes and her driveway and garage are on that side of her property.

The Aspen Glen DRC recommends to the Garfield County BOCC approval of the
proposed plat amendment as proposed on the Amended Final Plat Aspen Glen
Subdivision, Filing 1, Lot E8, drawn by JT dated 9/1/151.
The Aspen Glen DRC anticipates the opportunity to review the plat amendment
application submitted to Garfield County.
