2. The Applicant understands and agrees that Garfield County Resolution No. 2014-60, as
amended, establishes a fee schedule for each type application, and the guidelines for the
administration of the fee structure.
3. The Applicant and the County agree that because of the size, nature or scope of the
proposed project, it is not possible at this time to ascertain the full extent of the costs
involved in processing the application. The Applicant agrees to make payment of the Base
Fee, established for the Project, and to thereafter permit additional costs to be billed to the
Applicant. The Applicant agrees to make additional payments upon notification by the
County, when they are necessary, as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the
consideration of an application or additional County staff time or expense not covered by
the Base Fee. If actual recorded costs exceed the initial Base Fee, the Applicant shall pay
additional billings to the County to reimburse the County for the processing of the Project.
The Applicant acknowledges that all billing shall be paid prior to the final consideration by
the County of any Land Use Change or Division of Land.

Re: Michael Charles Kaiser and Sharon Aim Kaiser (the "Kaisers");
Kaiser Family Trust Instrument u/t/a November 15, 2002, as amended by that certain
Amendment No. 1 to the Kaiser Family Trust dated December 12, 2008 and that
certain Amendment No. 2 to the Kaiser Family Trust dated May 25, 2011 (as
amended, the "Trust" or the "Trust Instrument");
Lot Line Vacation Land Use Application (the "Application").
To whom it may concern:
I am writing in regards to the above -referenced Trust. The Kaisers inform me that they have
applied for a lot line vacation and that your office has requested a letter in accordance with Section
4-203(B)(1)(C) of the Garfield County Land Use and Development Code (the "Code"), which
provides as follows: "If the Applicant is an entity or a trust, the Applicant shall submit a letter
consenting to submission of the application signed by a person authorized to encumber the property
and a recorded Statement of Authority for that person."
This letter is in response to that requirement. In connection therewith, the Kaisers have provided
me a copy of the Trust. Article 9.01 of the Trust Instrument (entitled Designation of Trustee and
Successor Trustee) provides in pertinent part that the Kaisers are designated as Co -Trustees of the
Trust. The flush language of Article VII and Article 7.07 of the Trust Instrument provide that the
Kaisers, as Co -Trustees, are authorized to "manage, control ... partition, divide, improve and repair
trust property" in addition to all other powers "conferred by law" upon trustees. Accordingly,
pursuant to the Trust Instrument, Michael Charles Kaiser and Sharon Ann Kaiser are, jointly,
authorized under the Trust to submit the Application.
To that effect, the Kaisers, in accordance with the above referenced Code provision, by
countersigning below, acknowledge and represent that they are authorized to encumber the property
subject to the Application and consent to the submission of the Application by the Kaisers.

Garfield County Unified Land Use Resolution of 2008 ("ULUR") and C.R.S. §§ 24-65.5-101 et. seq. provide that
notice of hearings be given to the owners of mineral estates within the boundaries of the property subject to
your application for PUD and Preliminary Plan approval.
The title commitment prepared by Stewart Title Guaranty Company, Order No. 941686-C4 and Effective Date
February 9, 2011, references two interests in oil and gas in the property.
1. A 6.25% royalty interest, conveyed by quitclaim deed dated December 18, 1964, to T.M. Sanders,
recorded in Book 362 at Page 445; and
2. A reservation of an undivided 1/50 interest of all oil and gas lying under the property, by Ella J. Chase
in the deed dated June 12, 1948 and recorded in Book 258 at Page 594.
The title commitment does not indicate that a mineral estate owner has filed a request for notification as
provided in C.R.S. § 24-65.5-103(3).
8140 Partners, LLC searched the telephone directory of general use in Garfield County, and conducted a
search of the tax records at the Garfield County Assessor's Office. Neither the name nor the address of the
above persons could be located in either record. Moreover, a search of the Garfield County Assessor's records
did not reveal any mineral estate owner under the property.
Pursuant to C.R.S. § 24-65.5-103(2)(b), since the Garfield County records do not identify any mineral estate
owners, including their addresses of record, you are deemed to have acted in good faith and shall not be
subject to further notice obligations under the statutory notice requirements. Therefore there are no mineral
interests that require notice under the ULUR or statute with respect to this application.

Dear David,
have attempted to provide all the additional information requested in your
November 12th letter regarding the merger of the two lots my wife and I own in
Aspen Glen on which we have built our home.
With the printed copies of each document I have provided, I have also prepared
a digital copy of each as well as the revised plat on the enclosed CD.
I have also provided a letter from our attorney establishing my wife and I as
persons authorized under the Kaiser Family Trust to encumber the property.
With regards to your request for of a list of current mineral estate owners in the
Subject Site, I have provided a revised list that Leslie Lamont, Administrator of
the Aspen Glen Design Review Committee, filed for a client in 2013 which was
approved and recorded by the Garfield County Community Development
Department for the merger of two Tots in Aspen Glen. After reviewing the original
12/1/94 Aspen Glen plat as part of my research, it should be noted that no
change of ownership, except for the transference of ownership to Cora Gentry
from the estate of William Walter Gentry, has occurred for the past 20 years.
Additionally, I spoke to Amy Capron, who works for landscape architect, Greg
Mozian (also a member of the Aspen Glen DRC), and filed lot merger documents
in 2014 on behalf of Steve and Elizabeth Holtze, who own a home in Aspen
Glen, that included mineral rights ownership information very similar to mine. The
Holtze's lot merger application was approved and recorded in late 2014.
I am hopeful that I will not be required to further pursue the mineral rights
ownership listing beyond what minor modifications I have made from information
I found on the internet, to the list provided me by Leslie Lamont. I am quite
certain that the County has on file all the information necessary to notify those
mineral rights owners for whom addresses of record exist.
The only mineral rights owner on the list for whom no information has been found
is Ella J Chase who died in 1964, but was still listed as a mineral rights owner on
the Aspen Glen Plat in 1994. In a memorandum prepared by 8140 Partners in
2011, they stated that "neither the name nor the address of the above persons
(T.M. Sanders and Ella J. Chase) could be located in their search of the tax
records at the Garfield County Assessor's Office."
In reference to whether there are any liens existing on either property, there are
none.
Mr. Tuttle, the surveyor for our two lots, has amended the language on the plat
regarding all drainage and utility easements.
It is unclear to Mr. Tuttle and me whether the list of mineral rights owners needs
to be added to the actual plat. Additionally, I believe that we, the property
owners, have been properly identified on the revised plat with our notarized
signatures.
With the merger of the two Tots into one, we will vacate the building envelope
shown on F-27, eliminating any further development on that lot.

I have prepared a package of materials as per your instructions requesting the
merger of two lots we own in Aspen Glen. Our new house was completed in
June and sits within the original building envelope on Lot F-26. We purchase the
adjoining lot, F-27 in April and moved the original proposed driveway on F-26
over to encompass part of F-27. The remainder of that lot is landscaped.

This letter is to confirm that the Aspen Glen Design Review Committee (DRC), at their
April 30, 2014 meeting, reviewed the proposed plat amendment to combine Lots F-26 &
F-27 (256 & 286 Raptor Circle) into one lot and eliminate the building envelope on Lot
F-27. The DRC recommends approval to Garfield County of the proposed Amended
Final Plat of Lot F-26 and Lot F-27, Aspen Glen Plat Filing Number 1, dated April 8,
2014, drawn by DMC with the following conditions:
1. A copy of the recorded amended plat shall be provided to the DRC.
2. The DRC did not consider vacation of utility easements as it is the property owner's
responsibility to ensure vacation based upon service provider review.
3. Drainage easements are considered vacated by this plat amendment because the
property is improved with a single family residence which was constructed with
previously approved grading and drainage plans, and the DRC review of the proposal to
merge the properties considered grading and drainage as part of the improvements to
property which included landscaping on Lot F-27.
The DRC noticed property owners within the vicinity of the project site and no objections
were noted to the proposed lot tie. The DRC anticipates the opportunity to review the plat
amendment application submitted to Garfield County.
