Re: Aspen Glen Bike Path
Dear Mark
I am writing to follow up on my leffer dated June 7, 2002 to you regarding the above referenced
matter. I have attacfied to this letter a copy of a letter we received from DRT2, the contractor building the
bike path. As you can see, DRT2 believeJthat the bike path will be complete by the contract completion date
of July 15,2002. The brief construction status report contained in the letter indicates to me that the
completion date is most probable.
However, DRT2 has requested the right to extend the completion date to no later than August 15,
2002 inthe event that unforeseen problems arise. It is my understanding from discussions with them that
the possible need to extend the completion date until August 15ft is derived in large part because_telephone,
eleitric and other shallow utilities aie being installed under the bike path. These lines are installed directly
by the involved utility companies, and while everything is on schedule for a July 15 completion, the utility
companies sometimes operate behind schedule.
Based upon the foregoing, Aspen Glen states that the bike path throughout the Aspen GlgnPUD
along County Road 109 will be complete<i anci open to ihe public rto iater than August 15,2002. It is_rny
intention to tontact you in the next couple of days to arrange a time to get on an upcoming agenda of the
Board of County Commissioners to make sure that we have satisfied all of their concerns about this issue.

I am enclosing for your review and presentation to the Board of County Commissioners
duplicate copies of a proposed Condominium Map of Clublodge Condominiums, Lot 5, Aspen Glen
Clubhouse and Clublodge. Also enclosed is the Amended Plat Application Form and our check in
the amount of $140.00 which we understand to be the applicable fee.
Youwill recall thatthe five Clublodge lots were created bythe Final Plat, Aspen Glen Golf
Clubhouse and Clublodge, aresubdivision of Golf Clubhouse Parcel, Second Amended Plat Golf
Clubhouse Parcel, Aspen Glen, Filing No. 1. At that time each of the five Clublodge lots was
specifically approved to be condominiumized into two condominium units. The County has
previousiy approved tire c;nciominiumization of Ciublodge Lot.i by its exeoution onNovember 20,
2000 of the Condominium Map of Clublodge Condominium, Lot 4, and the recording thereof on
November 22,2000.
Clublodge, Inc., the owner of Clublodge Lot 5 and an affiliate of Aspen Glen Golf
Company would now like to condominiumize Clublodge Lot 5. The enclosed Condominium Map
is in the same format and contains the same information as that previously approved by the County
for the Condominium Map of Lot 4. We believe that it is and ready for presentation to the Board.
It is my understanding that the Board meets on July 1, 8 and 15. We are hopeful that the
enclosed Condominium Map can be approved and signed no later than the Board's last meeting in
July. I will contact you soon to see if there is anything that I can do to facilitate this process.

I received your voice mail message about the County Commissioners' lingering concerns
regarding Aspen Glen's completion of the bike path along County Road 109. The purpose ofthis
letter is to provide you and the Board with the best information I have today in response to your
question.
First, I was very surprised to hear that there is concern that Aspen Glen was considering
restricting public use of the bike path. Your message was the first time I have ever heard such a
thing and whomever may have suggested that to the Commissioners or to staff was completely
incorrect. A publicly accessible bike path through the length of the Aspen Glen property along
County Road 109 was a condition of Aspen Glen's original PUD and Preliminary Plan approval and
Aspen Gien Goif Company has aiways and does now intend to fuifiil ihat conditiorr. Aspen Gleii
has never considered restricting use of the bike path; it will be open to the public.
Next, since I received your voice mail message yesterday morning, I have not been able to
leam enough information to give you a firm opening date for the bike path. However, I am leaving
town tomorrow and will not be back in my office until Monday, June 17, so I wanted to tell you what
I know before I leave.
, Erom my personal observation (please go out and take a look yourself; the contractor is
making steady progress on the structural aspects of the bike path. I see no reason why they will not
meet the July 15, 2002 completion date in their contract, but I have not been able to reach the
contractor to confirm this. I was also unable to reach the design engineer to determine if there is any
work, such as the installation of signage, which will have to be completed before the bike path can
be opened, and how long such work might take after the structural work is done. I have asked the

Dear Mark:
In accordance with our discussion this morning I am herewith delivering to you the fully executed
mylar of the Condominium Map Clublodge Condominiums, Lot 5. For your information, I am also
enclosing a copy ofthe Power of Attorney which me gives me the authority to sign on behalf ofthe owner,
Clublodge, Inc. The original of this Power of Attorney will be recorded at the same time as the Plat.
Based upon our discussion this morning, it is my understanding that you will take this Plat down
to Sam Phelps' office for his review and signature. As I told you, I talked to Sam yesterday and let him
know that this Plat would be awaiting him when he comes into his office on Thursday.
Finally, it is my understanding that this Condominium Map has been placed on the Board's consent
agenda for this coming Monday, July 15n, for signature by the Board.
