two hundred feet (200') of the proposed amended plat, mineral owners and lessees
of mineral owners of record of the property to be a part of the amended plat, and
tenants of any structure proposed for conversion.
Evidence of the soil types and characteristics of each type.
Proof of legal and adequate source of domestic water for each lot created (which
may consist of proof described in Section 8:42(D) of the Subdivision Regulations),
method of sewage disposal, and letter of approval of fire protection plan from
appropriate fi re district.
lf connection to a community or municipal water or sewer system is proposed, a
letter from the governing body stating a willingness to serve.
The Applicant shall sign the "Agreement For Payment" form and provide the Base

This correspondence seryes as an application on behalf of Eagles Nest at Aspen Glen - Tract B
Hommumers Associatioru Inc. (the "Applicanf ) requesting an ame,ndment ofthe Final Plat ofEagles Nest - Tract
B P.U.D., a Subdivision ofClub Villa, Tract B, attached hereto as Exhibit A ("Final Plat'). The purpose ofthe
Plat amendment is to change the designation of Lot 5 to read "Common Parking Parcel," which more
appropi"iately describes the limited use of the parcel. The use of the property will not change from original
approveduses andtheamendmentdoesnotincreasethenumberofsubdivisionlotsordwellingunits,resultinthe
maj or relocation of a road or add new roads, nor result in the relocation ofproperty lines. The proposed First
Amended Final Plat of Eagles Nest - Tract B P.U.D. is attached hereto as Exhibit B, and a letter from the
Applicant authorizing our submission of the Application is attached hereto as Exhibit E.

parcel ofEagles Nest at Aspen Glen - Tract B Homeowners Association, Inc., which senres as aparking area
forownersofl,ots 1-4oftheSubdivisionandsubsequentlycontainsnodwellingunits. TheApplicantissubject
to the Master Declaration ofCovenants, Conditions and Restictions for Aspen Glen (Master Cove,nants'). The
Master Covenants provide a definition of "Lot" that could be and has recently been interpreted to include Lot 5,

D. Water. Soils. and Govemmental Approval. We reqpectfullyrequest that i) the prcofoflegal and
adequate source ofdomestic water, ii) evidence of soils [pes and characteristics and iii) the letter from the
goveming body stating a willingness to serve be waived as these requiremorts were met as conditions to Final Plat
approval and no changes to use or adjustments to lot lines are being considered.

A. ProofofNotice. The publication, posting and mailing ofall notices will be executed upon a set
date of public hearing
B. Criteria. Werespectfullyrequestthatthe conditions inPart2, SubsectionA' oftheProcedural
Requiremelrts be waived as the criteria therein was satisfied as a condition ofFinal Plat approval and the current
requestforamendme,lrttotheFinatPlatdoesnotresultintherelocationofproperlylinesnorachangeinanyuse.
In summary, the proposed Amended Fina1 Plat ofEagles Nest - Tract B P.U.D. is no more than a change
in wording and does affect use, properfy lines, roads, nor the number of dwelling units. Thank you for your

Eagles Nest at Aspen Glen - Tract B PUD
On May 3,2005, a First Amended Final Plat of Eagles Nest at Aspen Glen - Tract B PUD
(the "Plat") was presented before and subsequently approved by the Board of County
Commissioners. The Plat was then sent from Jim Hardcastle to you, as County Surveyor, for your
comments. ln a conversation with our firm's paralegal, you mentioned that it was possible to have
comments on the Plat completed by July l9n. Since this date, our office has left three unreturned
messages with you regarding its status.
It has now been four months since the Commissioners' approval. It should not take that long
for review of any plat, much less a very simple one. If deluyr^of thir nature are commonplace, ii
indicates a need to analyze the demands on your time, in general, and the requirement for County
Surveyor review ofplats, in particular. If the demands on your time are so overwhelming that a one-
page plat can't be reviewed in a matter of weeks, much less four months, something needs to be
fixed.
I would greatly appreciate it ifyou will contact me with the status ofthe Plat or let me know
if there is anything further you need from our office to expedite its approval.
