HomeMy WebLinkAbout2.0 Staff Report BOCC 11.17.03BOCC -tut7t03 FJ PROJECT INFORMATION AND STAF'F' COMMENTS TYPE OF REVIEW: APPLICANT(S): LOCATION: ZONING: Amended Plat (Public Meeting Agenda) Coryell Ranch Company represented by Balcomb & Green, PC Lot WP20, Aspen Glen, Filing No. 6. PUD I. DESCRIPTION OF THE PROPOSAL The Applicant is requesting approval from the Board of County Commissioners to amend a lot line for Lot WP20 within Filing No. 6 of Aspen Glen. Specifically, the Applicant requests approval from the Board to modiff two exterior boundary lines of Lot WP20, Aspen Glen, Filing No.6. so that the exterior boundary lines of the Lot conform to the as-built locations of Midland Loop and Bald Eagle Wuy , which are the streets bordering the Lot. This Application will also make the exteriorboundary lines of the Lot conform to adjacent filings of Aspen Glen. TheApplicantprovided anarrative explaining therequestto amendthelotlines which states "during construction, which occurred over five years ago, the intersection of Golden Bear Drive and Midland Loop was relocated slightly from that shown on the original Final Plat of Aspen Glen, FilingNo.6. This relocation was discovered in the Spring of 2003 when the Applicant prepared and subniitted the Final Plat for Aspen Glen, Filing No.4, which lies to the south of Lot WP20. The effect of the relocation of the intersection was to create a "no man' s land" between the constructed roadways and the platted boundary lines of Lot WP20. This Application to amend Lot WP20 is being submitted to conform the boundary lines of that Lot to the actual, as-built locations of the adjacent rights-of-way for Midland Loop and Golden Bear Drive. The relocation of these property lines will slightly increase the size of the Lot, so that the Lot will be in compliance with the minimum lot size for its zone district within the Aspen Glen PUD." By adjusting the lot, the building envelope on the newly configured Lot will also slightly expand to make it follow the new exterior boundaries of the Lot. Staffconcurs that the new building envelope satisfies all the setback requirements from the new exterior boundaries of the Lot. tr. REGT]LATORY AUTHORITY Section 6:10 of the Subdivision regulations states that an amendment may be made to a recorded plat, if such amendme'nt does not 1) increase the number of subdivision lots or dwelling units, or 2) result in the major relocation of a road or add new roads. This request will not increase the number of subdivision lots or dwelling units and will result in the major relocation of a road or add new roads. STAFF RBCOMMENDATION The Applicant has provided all required documentation and has satisfied the applicable standards for a plat amendment. Further, the minor adjustment to the lot will continue to be consistent with all of the other lots within Filing No. 6 of Aspen Glen regarding lot size and setbacks / building e,nvelopes. Therefore, recommends the Board of County Commissioners, pursuant to Section 6:10 of the Subdivision Regulations of 1984, as amended, approve this amended plat request with the following condition: 1. That all representations of the Applicant, either within the application or stated at the meeting before the Board, shall be considered conditions of approval. ry.
