I. DESCRIPTION OF PROPOSAL -REQUEST
The Applicant is requesting an amended Final Plat for Lot H28 and H29 to combine said
lots into a single 1.091 acre lot. The proposal includes vacation and/or relocation of utility,
drainage, and irrigation easements located along the common lot line to be eliminated.
Adjustments to the building envelope for the combined lot are also being requested. The
property is zoned Planned Unit Development (PUD) and is within the Y, Acre Residential
Zone District of the Aspen Glen PUD.
II. AUTHORITY -APPLICABLE REGULATIONS
The Amended Final Plat Application is being processed in accordance with Section 5-304,
Amended Final Plat and 4-103, Administrative Review of the Unified Land Use Resolution
of 2008 as amended (ULUR). The request was determined to be complete as of March 13,
2013. Public notice was required for the Director's Decision in accordance with Section 4-
103 and 4-101.
Ill. STAFF ANALYSIS
1. The Applicant's draft plat includes improvement location information on the existing
home and proposed addition. The plans reflect that the improvements will comply with the
proposed building envelopes for the amended lot.
2. The Applicant's submittals indicate that the proposed construction will comply with
the Yi Acre Aspen Glen PUD Zoning in effect for the lot. Supplemental information from
the Applicant also indicates that the combined lot will also comply with the zoning district
standards for the 1 acre Aspen Glen PUD Zoning.
3. The Applicant has provided information and email correspondence indicating that
the various utility providers (cable, electric, gas, telephone) are in agreement with the
vacation of the utility easement along the shared property line between Lots H28 and H29.
The documentation of their approval of the vacation will be subject to acceptance by the
County Attorney's Office. Additional documentation may be required by the County
Attorney's Office.
4. The Application was referred to the Aspen Glen Homeowners Association. Their
approval is indicated on the draft plat (see Exhibit A) and their letter of conditional approval
of the request attached as Exhibit B. The adjustment to the Building Envelope shown on
the proposed plat was requested by the Homeowners Association. The adjustments to the
building envelope results in a slight reduction in the overall building envelope area for the
combined lot as compared to the building envelope area forthe lots as originally platted.
5. The Application was referred to the County Surveyor and his technical comments
shall be required to be addressed prior to final execution and recording of the amended
plat.
6. Review of the amended plat by the County Attorney's Office will be conducted prior
to presentation of the plat for signatures. All concerns of the County Attorney's Office
including signature blocks and easement vacations shall be addressed by the Applicant.
7. Confirmation from the Aspen Glen Homeowners Association that they have
approved the vacation of the drainage and irrigation easements along the common lot line
will be required.
8. The Applicant has provided copies of proof of mailing of the public notice to the
adjacent property owners and owners of mineral rights on the subject property. No public
comments from adjacent property owners were received by the Community Development
Department.
IV. SUGGESTED FINDINGS AND RECOMMENDATION
Staff supports a finding that the Amended Final Plat Application for Lot H-28 and Lot H-29

of Aspen Glen Filing No. 7 meets the requirements and standards of the Garfield County
Unified Land Use Resolution of 2008 as amended and is recommended for Administrative
Approval by the Director of the Community Development Department subject to the
following conditions of approval.
1. That all representations of the Applicant contained in the Application submittals shall
be conditions of approval unless specifically amended or modified by the conditions
contained herein.
2. All requirements from the County Surveyor shall be met prior to submittal of the plat
for final execution.
3. The Plat including easement vacations shall be subject to final review and approval
by the County Attorney's Office prior to submittal of the plat for final execution. Additional
documentation for approval of the easement vacations may be required by the County
Attorney's Office.
4. The Plat shall include a plat note indicating the purpose of the amended plat to be
the combination of Lots H28 and H29 and an adjustment to the building envelope for the
combined Lot HH28. A plat note shall also be included indicating that all previous plat
notes set forth on the Final Plat of Aspen Glen, Filing No. 7, recorded at Reception No.
552596 and any amendments thereto shall remain in effect.
5. The Applicant shall provide documentation from an authorized representative acting
on behalf of the Aspen Glen Homeowners Association that the drainage and irrigation
easements to be vacated on the common lot line between Lots H-28 and H-29 are not
needed for implementation of the Aspen Glen drainage and irrigation plans.
6. The Amended Plat shall be subject to compliance with the Aspen Glen Homeowners
Association approval letter dated 12/20/12 and attached as Exhibit B.

Dear Glenn, thank you for the opportunity to comment on the Britz-Aspen Glen Amended Plat lots H-28 & H-29 Filing
No . 7 . As the Design Review Administrator for Aspen Glen I have reviewed the appflcatlon submitted by Mr. Britz's
representative . The draft plat is consistent with the draft plat that was presented to the Design Review Committee in
late 2012. The merged properties and the adjusted buifdlng envelop are consis t ent with what was reviewe d and
approved by the ORC . I have attached a letter that was drafted to Garfleld County outlining the DRC's review and
approval. Aspen Glen approved of the amended plat.

proposed plat amendment to combine Lots ft-28 & H-29 (0014 Saddlebom Court & OOM
Saddlohorn Court) into one lot The plat amendment also lllCl'tlU lhe two building
envelopes. The DllC approved the lot tie and recommends approval to tho Garfield
County noaro of Cnunty Commission""' with the following conditions:
I. The plmted building envelope for Lot H-29 is reduood at the north end of the lot equal
to the amount of buildlog envelope that is gained by joining !he two lots and their
building envelopes.
2. The DRC did oot approve the building ellvelopo adjuslment proposed for the soud!
side of the bui]dillg envelope ofLot H-29 bee.a use it would allow future dcvtlopmeot too
close to the adjacent property. This eovelope adjustment was proposed to align the
building envelopes of both lots because the envelope on H-28 was adjusted from a 20
foot setback to a 10 foot setback. Also, the Aspen Olen Daign Guidelines Section S.4
