FERGEN AND LARA M. FERGEN Dear Fred: As discussed, I am submitting the enclosed Subdivision Application — Final Plat Amendment/Correction Plat for Michael J. Fergen and Lara M. Fergen, for property located at 0476 JB Court, Glenwood Springs, CO 81650, also identified as Lot 15 of Canyon Creek Estates Subdivision ("Fergen Property"). The purpose of this Application is to amend the Fergen Property to include 0.56 acres of land that is currently a part of property owned by Letha Sue Sills, as further discussed below. As can be seen from the Final Plat and Amended Final Plat of Lot 15 (submitted herewith), the Fergen Property is adjacent to a parcel of land owned by Letha Sue Sills ("Sills' property). The Fergens and Jimmy Sills, who is now deceased, previously attempted to complete a boundary line adjustment between the Fergen Property and Sills' property in 2004 for roughly the same amount of acreage as is set forth in the attached Application and Amended Final Plat, and received approval from the Garfield County Board of County Commissioners to amend the boundary line at that time. However, this process was not concluded as Applicants were unable to obtain all of the necessary signatures on the Final Amended Plat. At the time of the 2004 application and proceedings regarding the boundary line adjustment, the Sills' property was owned in joint tenancy by Letha S. Sills and Jimmy M. Sills. Jimmy M. Sills died on or about June 11, 2009, and as a result, Letha S. Sills is now the sole owner of the property. An Affidavit Evidencing Termination of Joint Tenancy signed by Letha S. Sills and related documents were filed in the records of the Garfield County Clerk and Recorder's Office at Reception No. 781184. In addition, a Quit Claim Deed from Letha S. Sills to Fergens for the .56 acres was filed in the records of the Garfield County Clerk and Recorder's Office at Reception No. 781222 on January 27, 2010. The Affidavit and Quit Claim Deed are OLSZEWSKr, MASSIII & MAUREIR, P.C. Fergen Application January 7, 2011 Page 2 of 3 attached hereto. Since the Sills' Property was encumbered by a first Deed of Trust with Banc of America Mortage Securities, Inc. ("Bank"), and there were other parties that may claim an interest in the 0.56 acres of property, it was necessary for Fergens to file a Complaint Under Rule 105 in the Garfield County District Court to quiet title to the 0.56 acres of property (Garfield County District Court Case No. 2010CV30). The Bank has now executed a Request for a Partial Deed of Trust for the 0.56 acres of property, which was recorded November 22, 2010 at Reception No. 794735 in the records of the Garfield County Clerk and Recorder (attached hereto). I have also attached the Disclaimer filed by the Bank in Case No. 10CV30. Because of concerns that an amendment to the Fergen Property be handled in the proper manner, Garfield County Board of County Commissioners was a named defendant in Case No. 10CV30. This Application is tendered to properly amend the Fergen Property and should resolve concerns articulated by the County. No new or expanded access to the Fergen Property is being requested as a result of this Application. At the time of approval of and recording of the Amended Final Plat, Fergens will also have the attached Affidavit Regarding Boundary Line Adjustment recorded, which will complete the boundary line adjustment. I have attached three sets of the following required application materials for your review: 1. Subdivision Application for a Final Plat Amendment (with application fee of $100.00) and signed Agreement for Payment Form; 2. A copy of the Warranty Deed for the Fergen Property and the legal description for the portion of the Sills' Property to be incorporated into the Applicant's property; 3. Letter authorizing Melody D. Massih to act as Fergens' agent for the purposes of this Application; 4. Assessor's map showing the subject property and all adjacent landowners and a list of all property owners within 200 feet of the Property (there are no additional mineral interest owners of the Fergen or Sills properties); 5. U.S.G.S map showing slope/topography of the property; 6. Final Recorded Plat for Canyon Creek Estates, recorded at Reception No. 434857 in the records of the Garfield County CIerk and Recorder's Office; and 7. Application materials that are specific to an individual application type (Conservation Subdivision, Preliminary Plan, etc.) are detailed in Section 5-501 of Article V of the Unified Land Use Resolution (ULUR) of 2008. 1. Submit a completed and signed Application Form, an application fee, and a signed Agreement for Payment form. 2. A narrative explaining the purpose of the application and supporting materials that address the standards and criteria found in Article VII of the Unified Land Use Resolution of 2008. 3. Copy of the deed showing ownership. Additionally, submit a letter from the property owner(s) if the owner is being represented by another party other than the owner. (That information may be found in your title policy under Exceptions to Title). 5. Vicinity map: An 8 1/2 x 11 vicinity map locating the parcel in the County. The vicinity map shall clearly show the boundaries of the subject property and all property within a 3 -mile radius of the subject property. The map shall be at a minimum scale of 1"=2000' showing the general topographic and geographic relation of the proposed exemption to the surrounding area for which a copy of U.S.G.S. quadrangle map may be used. 6. A copy of the Pre -Application Conference form. 7. Submit 3 copies of this completed application and all the required submittal materials to the Building and Planning Department. Staff will request additional copies once the application has been deemed technically complete. The following section outlines and describes the subdivision processes for the variety of subdivision actions that are governed by the Board of County Commissioners by the Unified Land Use Resolution of 2008 (ULUR). Please refer to Article V in the regulations themselves for a higher level of detail. I. THE SKETCH PLAN The sketch plan process (more fully defined in Article V, Section 5-301 of the ULUR) is an optional plan review process intended to review at a conceptual level the feasibility and design characteristics of the proposed division of land. The Yield Plan Review process, set forth in Section 5-309, may be combined with Sketch Plan Review for applications proposing Conservation Subdivision. A. Process: The Sketch Plan Review process shall consist of the following procedures and as more fully described in Article V, Section 5-301 of the ULUR: 1. Application 2. THE FINAL PLAT AMENDMENT / CORRECTION PLAT REVIEW The purpose of the Final Plat Amendment review is to allow for certain amendments to an approved Final Plat. An amendment may be made to a recorded Final Plat if such amendment does not increase the number of subdivision lots or result in a major relocation of a road or add one or more new roads (pursuant to Section 5-306). A correction can be made to a recorded plat in order to correct an engineering error, mislabeling issue, etc. that does not affect the substance of the plat. A. Outline of Processes. The review processes for amending a Final Plat or an Exemption Plat shall consist of the following regardless of whether the division was initially approved as a subdivision or an Exemption: 1. Four (4) Subdivision Lots: The Administrative Review Process, detailed in Section 4-104 of Article IV, shall be used for review of a request to amend or correct a Final Plat modifying lot lines, building envelopes, easement locations or other interests affecting up to four (4) subdivision lots. An Amended Final Plat or an Amended Exemption Plat which modifies lot lines or easements affecting not more than two (2) adjacent lots or Exemption Lots or a single building envelope shall be subject to the Administrative Review Process set forth in Section 4-104 of Article IV, with the addition of presentation of the Amended Plat to the Board of County Commissioners for signature, prior to recording with the Office of the Clerk and Recorder. 2. More Than Four Lots: The Major Exemption Review Process, detailed in Section 5-403, shall be used to amend a Final Plat or an Exemption Plat modifying lot lines, building envelopes, easement locations or other interests affecting more four (4) subdivision lots or Exemption Lots.
