I was checking to see if we have heard anything more from the County Surveyor, or if final comments have gone to Fergen's surveyor yet. I would like to get this wrapped up and the plat finalized, and it sounds like the County staff is in agreement with my comments below. Please let me know when we can expect these final comments or if I need to just contact Fergen's surveyor and let them know to go ahead with the final amended plat with the changes as requested by the County Surveyor (other than the three items set forth below). Also, when are we scheduled to have this matter before the BOCC? Let me know if the March 7 meeting has been rescheduled to a different date due to lack of quorum. I do have a few comments regarding the decision letter and the letter from the County surveyor: 1. In number 3 of the surveyor's comments, he states that the cul-de-sac street needs to be named. However, this is not a road, it is a shared private driveway and does not have a name. 2, Both the decision letter (paragraph 2(d)) and the surveyor letter (number 9) state that a mortgagee/lien holder certificate be added to the plat if applicable. The piece of property that has been conveyed and is the subject of the amended plat and boundary line adjustment has been released by the Bank of America, the only entity having an encumbrance on this property. There are no other lien holders affecting the parcel being conveyed. 3. In number 10 of the surveyor's comments, he states that the owner of the parcel transferring property needs to be added as a signatory to the plat. I am unsure as to why this needs to happen, as we -have ample documentation that both the Bank who is foreclosing on the transferring property as well as the owner being foreclosed upon have both agreed to this transfer. This may cause a logistical problem, as both the Bank and "owner" (Sue Sills) are not located in Garfield County. I would request that these conditions be removed if possible. All other comments are fine and these changes/additions can be made. I am happy to speak with the County attorney's office in this regard or with you further about these conditions. There is also a call-up period associated with this type of Administrative review, so we anticipate the plat may be presented to the Board of County Commissioners for signatures on March 7th. Amended Lot 15 Date: February 17, 2011 Dear Don, Upon review of the Canyon Creek Estates L15 Am Plat, I have prepared a list of comments or corrections to be made prior to approval for survey content and form. 1. The Basis of Bearings Statement is incomplete and needs to describe monuments used. 2. The Southwest 1/16 comer needs to be described and a distance added from the northwesterly corner of Lot 15 to the found monument. 3. Add street name in Cul -d -Sac. 4. Recording information for the "Correction Plat of the Amended Final Plat of Lots 15, 20-42, Tract D and Tract H of Canyon Creek Estates Subdivision should be added to the header and property description. 5. Owner information added to the Certificate of Dedication and Ownership where able, (text rather than hand written information). 6. A statement describing the units of measure use to prepare this Plat. 7. A statement describing the purpose of this Amended Plat. 8. Updated certificates need to be used and can be obtained from Garco Building and Planning, (See attached). A Mortgagee Certificate needs to be added if applicable.
