Dear Fred:
Our firm represents Cindy Crandell, trustee of The Cynthia H. Crandell Family
Trust Dated May 24, 2011, which owns property located in the Canyon Creek area of
Garfield County. Ms. Crandell and her neighbors, Michael and Lara Fergen (represented
by Lucas Van Arsdale of Balcomb & Green, P.C.), want to adjust a portion of the
common boundary between their respective properties as set forth in the enclosed
application materials. Ms. Crandell's parcel is described by metes and bounds, but the
Fergens' lot is part of the Canyon Creek Estates Subdivision. As such, a final plat
amendment for the Fergen property is required to effectuate the boundary line
adjustment.
Enclosed for your review are three sets of the following application materials in
hard copy and one set on CD:

GARFIELD COUNTY ("COUNTY") and Property Owner ("APPLICANT") Michael and Lara Fergen
and The Cynthia H. Crandell Family Trust Dated May 24, 2011 agree as follows:
1. The Applicant has submitted to the County an application for the following Project:
Boundary Line Adjustment and Final Plat Amendment
2. The Applicant understands and agrees that Garfield County Resolution No. 98-09, as
amended, establishes a fee schedule for each type application, and the guidelines for the
administration of the fee structure.
3. The Applicant and the County agree that because of the size, nature or scope of the
proposed project, it is not possible at this time to ascertain the full extent of the costs
involved in processing the application. The Applicant agrees to make payment of the Base
Fee, established for the Project, and to thereafter permit additional costs to be billed to the
Applicant. The Applicant agrees to make additional payments upon notification by the
County, when they are necessary, as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the
consideration of an application or additional County staff time or expense not covered by
the Base Fee. If actual recorded costs exceed the initial Base Fee, the Applicant shall pay
additional billings to the County to reimburse the County for the processing of the Project.
The Applicant acknowledges that all billing shall be paid prior to the final consideration by
the County of any Land Use Change or Division of Land.

1 GENERAL PROJECT DESCRIPTION
Adjacent property owners seek to amend the common lot line between the two, however
one of the lots is within the Canyon Creek Estates Subdivision and one lot is unplatted.
This will require both and amended plat for the subdivision lot and a BLA for the unplatted
portion. The County does review the amended plat but not the BLA -- through the amended
plat process we will ensure that necessary documents for the BLA are recorded
simultaneously with the amended plat.
H. REGULATORY PROVISIONS APPLICANT IS REQUIRED TO ADDRESS
Garfield County Unified Land Use Resolution Sections:
Plat Amendment process is Administrative and will require submittal of the following:
e Deed or title commitment to demonstrate ownership
• Adjacent property owners (within.200) names and mailing addresses
d Copy of assessor map of the parcels
• Application form and fees
• Amended plat for lot 15 .
• Letter of authorization of Crandell will represent the Fergens.
Section 5-502 — submittal requirements:

2. Application Form and Fee as well as on a disk in pdf format;
3. A copy of the proposed Amended Final Plat;
4. Narrative of request and any supporting documentation;
5. Amended plat pursuant to state statute and 5-502 C.5.

d. Upon determination of a "complete" application several things happen concurrently:
i. The date of Director Determination will be set (within 30 days)
ii. Public Notice to adjacent property owners is completed by the applicant (staff

ill. Additional copies of the application materials are requested -- for referral
agencies
e. Planner reviews application and referral responses and completes a report of the
project
f. Director makes a determination on whether to approve, approve with conditions, or
deny the application
g. Applicant obtains certain signatures on a "mylar" of the plat and submits to staff
h. A 10 -day call-up period occurs with the Board of County Commissioners given the
option to require a public hearing
i. If no call-up is requested then the amended plat is placed on the Board Consent
Agenda and, once signed by the BOCC, is recorded.

Planner reviews case for completeness and sends to referral agencies for comments. Case planner contacts
applicant and sets up a site visit. Staff reviews application to determine if it meets standards of review. Case
planner makes a recommendation of approval, approval with conditions, or denial to the appropriate hearing
body.

BOUNDARY LINE ADJUSTMENT AFFIDAVIT
The undersigned affiants, being first duly sworn, depose and state as follows:
1) We are the owners of real property in the unincorporated area of Garfield County, which
real properties are described in Exhibit A attached hereto and incorporated herein by
reference.
2) We are desirous of adjusting the boundary lines of our parcel and lot and sign this
Affidavit in accordance with the Garfield County Unified Land Use Resolution of 2008,
as amended.
3) We hereby represent that no new parcels or lots will be created and, therefore, that
Garfield County will not be required to issue any building permits other than what it
would be required to issue for the already existing parcels or lots.
4) We hereby represent that one of the lots involved in this boundary line adjustment is part
of a previously platted subdivision of record and acknowledge that a Final Plat
Amendment is also required to effectuate the boundary line adjustment, as more fully
defined in Article V of the Garfield County Unified Land Use Resolution of 2008, as
amended.
5) We hereby represent that the boundary line adjustment made reference to herein will not
cause the loss of access by road or to utilities to any parcel or lot involved.
6) We hereby represent that the boundary line adjustment being made will not result in any
of the parcels or lots involved being less than the minimum lot size in their applicable
zone district allowed as a result of the boundary line adjustment or create any non-
conforming setbacks for any existing structures.
7) We hereby represent that a copy of the Affidavit will be recorded with the Garfield
County Clerk and Recorder.
