FINAL PLAT TELEPHONE 970 - 625-1887 FAX 970 - 625-4448 We are writing this letter on behalf of our client, Canyon Creek Estates Homeowners Association, the owner of the common rights-of-way and improvements located on the Canyon Creek Estates P.U.D. final plat ("P.U.D."). This correspondence is to follow up on the request made to the Board of County Commissioners at the September 8, 1998 meeting of the Commissioners. We are requesting you consider an amendment to the specifications for a portion of the upper road and cul de sac on the P.U.D. The engineer for Canyon Creek Estates Homeowners Association will be forwarding detailed specifications to you in the near future illustrating our request for the amendment to the P.U.D. We understand our request for the approval of P.U.D. plan amendments is set for a public hearing to take place on October 12, 1998 at 11:00 a.m. A Public Notice setting forth the information regarding the October 12, 1998 public hearing was delivered to a local newspaper for publication on Friday, September 11, 1998. This Notice will be published more than thirty (30) days prior to the public hearing. At the public hearing, we will seek approval of the P.U.D. plan amendments as presented, and request a resolution which will vacate Resolution No. 95-049, dated July 3, 1995, and recorded in Book 945 at Page 911, on July 6, 1995. We will also be requesting that the commissioners reinstate Lots 15 and 33 (also identified as Parcel Nos. 2123 253 24 025 and 2123 253 24 014), on the P.U.D., and for the commissioners to permit and approve, by way of a resolution, the immediate completion of the upper road and cul de sac for the subdivision according to the detailed specifications submitted by our engineer. Enclosed is a current, updated list of all of the owners of lots located in the P.U.D. We have mailed copies of the Public Notice regarding the October 12, 1998 hearing to all of these lot owners via certified mail. BOARD OF COUNTY COMMISSIONERS September 10, 1998 Page Two We are more than willing to continue to work with the County to resolve any concerns regarding our P.U.D. amendments, and are confident that we will have the County's concerns addressed and resolved in advance of the October 12, 1998 hearing.
