RESOLUTION NO. 83-)13.
A RESOLUTION CONCERNED WITH H APPROVAT: 0'r' THE PRELIMINARY PLANT OF THE CANYON CREEK
PLANNED. UNIT DEVELOPMENT.
WHEREAS, the Lazier -Sills Partnershiphas filed an application with the Board
of County Commissioners of Garfield County for approval of a;Preliriinary Plan in.:,
-
the Planned 'Unit Development Zone Distridt; and
WHEREAS,ibased on the material submitted -'by the applicant'andthe comments"
of the Garfield County Planning•Department, this -Boards finds as'f011ows;
1. Thatproper publication and public notice was provided as•required,by law
for the hearing thefore the Planning Commission.
2. That ,the hearing before the Planning Commission was extensive and''. complete,
that ;all pertinent facts, matters,' and issues were submitted and that all interested
parties were heard' at that hearing.
3. That the Garfield County Planning Commission recommended'approval of the
Preliminary. Plan.
4. That the proposed subdivision of land is in compliance With the recommendation;
set forth in the Comprehensive Plan for the unincorporated area of the county.
5. That all data, surveys, analyses, studies, plans 'and designs as required
by the State of.Colorado and Garfield County have been .submitted, '.reviewed and found
to meet all sound planning and engineering requirements of the Garfield County
Subdivision Regulations.
6. That the proposed subdivision of landconforms to the Garfield County Zoning
Resolution.
7. That for the above stated and other reasons, the proposed subdivision is in the
welfare of the citizens of GarfieldC��untls,'convenience, order; prosnerityand
best interest of the health,safety,mora

NOW, THEREFORE, BE IT RESOLVED that the Preliminary Plan of the Canyon Creek
Planned Unit Development be 'approved with the following conditions:
1. The boundary on Lot 44 shall reflect the potential aliquot resubdivision of

2. Prior to approval of the Final Plat, the County shall receive a letter
from the Fire District, wh!un details and approved the location of fire hydrants, and
said improveinents shall he included in the Subdivision Improvements Agreement.'
3. 'A school fee equivalent to the value of 1.24 acres, which amount shall be
approved by the School District, shall be paid tb. the RE -1 School District ,as a
condition of Final Plat approval.
4. The Division of Water Resources shall review and recommend approval of the
Final Plat in terms of conformance with the Final augmentation plan prior to submittal
of the Final Plat.
5. The applicant shall prepare a Fire Protection Plan to mitigate wildfire hazards,:
which Plan will include the stated conditions of the Colorado State Forest Service.
In addition, the proposed covenants shall be modified sothat the Architectual Control
Committee will allow selective outings. The covenants will also otherwise conform
to the stated conditions of the Colorado State Forest Service.
6. All easements, including utility, ditch, road and off-site drainage easements
shall 'be: shown on .the.'Final Plat.
7. Prior to Final: Plat approval, the Board shall receive a letter from all utility
companies, which letters state approval of all easement and utility layouts. _
8. All lots will be connected onto the existing sewer lines, except Lots 14, 43, and

Survey, exceptthose recommendations as to septic systems.
