OF - THE CANYON: MEEK PLANNED UNIT DEVELOPMENT PLAN. .WHEREAS,' The Lazier -Sills Partnership has .filed a petition with the Board of County Co issioner.s. of Garfield 'County, Colorado, for approval of a- modificatir.n of. the Canyon: Creek Planned ;Unit' Development Plan, in accordance with Section 10.0:of the Garfield County' Zoning' Resolution'of 1978, as amended; WHEREAS, previously thisPA .Board approved Resolution ,No. .81-316` . which was concerned ' with . the approval ' of a' Zone : District Amendment to the Garfield County Zoning. Resolution and Planned Unit Developinent for Canyon Creek by Jimmy .Sills; WHEREAS, .a public hearing. was held as: to the proposed modification, which hearingoccurred on November 1, 1982; WHEREAS, based on the evidence, testimony, exhibits, study of the master plan for the unincorporated area -of the County, comments of the:. A Garfield County Planning :Department, comments of public officials'. and agencies, comments from all interested parties, this Board finds as follows: 1. That proper publication and public notice was providedas required by law for' the hearing before the Board; 2. That the hearing before the Board was extensive and complete, that all pertinent facts, matters, and issues were submitted and that all interested parties were heard at the hearing; 3. That the Garfield County Planning Commission has recommended to this Board that the requested zoning change be granted, provided that certain conditions be. addressed prior to the recording of the. final plats; - 4. That -the proposed zoning is in general compliance with the recommendations setforth in the master plan for the unincorporated area of. the County; 5. That the proposed land use will be compatible with the existing land uses in the nearby area; 6. That the requested modification of the Planned Unit Development'Plan mets all requirements of the zoning resolution of Garfield County, and further, that the requested planned unit development is suitable . and appropriate for the subjeet property concerning the! location, condition and circumstances of said property, and that the proposed amendment. implements the purposes and meets the standar_ddsand requirements of the planned unit; development provisions o1 the Garfield County Zoning Resolution;_ BOOK 621 mcE514 7. That for the above stated and other reasons, the proposed zone district amendment and planned unit development plan is in the best interest of the health, safety, morals, convenience, order, prosperity, and welfare of the citizens. of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the petition of Lazier -Sills Partnership for a modification of•the•Planned Unit Development Plan of the Canyon Creek Planned Unit Development • for the..following described unincorporated area of Garfield County be and herebyis granted and approved subj4ct to the following conditions: LEGAL DESCRIPTION: Exhibit A attached 1. That the Canyon Creek Planned Unit Development shall consist of the following zoning districts, the boundaries of which shall be.indicated upon final. plat of Canyon Creek Planned Unit Development, or various final plats thereof, which districts shall be identified -as follows: See Exhibits B (Text) and. .0 (Map) attached 2. Building Height: Measured vertically from the average natural finished grade line immediately adjoining the foundation to the average roof height, Community Facilities: Public restrooms and meeting facilities designed alone- or in c^njunction with .recreational facilities.
