GARFIELD COUNTY (hereinafter COUNTY) and

1. APPLICANT has submitted to COUNTY an application for ___________ _
____________________ (hereinafter , THE PROJECT).
2. APPLICANT understands and agrees that Garfield County Resolution No. 98-09, as amended,
establishes a fee schedule for each type of subdivision or land use review applications , and the guidelines for the
administration of the fee structure.
3. APPLICANT and COUNTY agree that because of the size , nature or scope of the proposed
project, it is not possible at this time to ascertain the full extent of the costs involved in processing the
application. APPLICANT agrees to make payment -0f the Base Fee, established for the PROJECT , and to
thereafter permit additional costs to be billed to APPLI CANT. APPLICANT agre es to make additional
payments upon notification by the COUNTY when they are necessary as costs are incurred .
4 . The Base Fee shall be in addition to and exclus ive of any co st for publication or cost of consulting
service determined necessary by the Board of County Commissioners for the consideration o f an application or
additional COUNTY staff time or expense not covered by the Base Fee . If actual recorded costs exceed the
initial Base Fee, APPLICANT shall pay additional billings to COUNTY to reimburse the COUNTY for the
processing of the PROJECT mentioned above. APPLICANT acknowledges that all billing shall be paid prior to
the final consideration by the COUNTY of any land use permit , zoning amendment , or subdivision plan.

RE: Guggenheim Lot 53 in Cerise Ranch
This letter is to serve as evidence that Mr . Guggenheim and the Cerise RB!lch Subdivision Homeowners
Association Board of Directors (HOA) arc in communication regarding the situation ofa proposed building
envelope and easement revision on Lot 53.
As the beneficiary of this easement, the HOA, understands the needs of Mr. Guggenheim to Telocate an
existing casement on his Jot to remedy a current encroachment into the easement by a portion of his home .
It is the understanding of the HOA that although the HOA is the beneficiary of this easement, the only
current user of this easement is Mr. Cerise who has an irrigation line in place within the easement
connecting to his home outside the PUD. As stated in the letter you recei.ved this week ftom Mr. Dennis
Cerise , he and Mr. Guggenheim have a mutual tmdermanding as to the impacts and related responsibilities
regarding the pipe in the easement.
As far as the HOA is concerned, we would like be as belpfuJ as possible in assisting Mr. Guggenheim in
this process to allow for the contillllation of construction of hi s home. That being said, ultimately the HOA
will most certainly require survey work identifying the current building envelope and easements as well as
the p.rop<ised revisions to both. At witch time the documents are presented for review and approval, the
HOA would intend to do so with the understanding that all "to be" revisiomi are done within all applicable
building regulations of all related governing entities , and that all easement interests are preserved in a
ma1:mer in which the HOA can approve said changes with no harm created to any party as a result of the
relocati.on of this easement. All approved reY1sfons are to be recorded by and attbe expense ofMr.
Guggenheim at the Garfield Cotmty Co\Irt House as soon as possible after receiving such approvals .
The HOA understands that the curre.nt situation on Lot 53 would benefit from all the i.tews mentioned
above being completed this week. This will not be possible . With the understanding of Mr. Guggenheim's
position, I hope that this letter is adequate for your needs to allow for the continuation of the construction
efforts currently lmderway.
As evidenced below by mutual signatures, we are in the process of resolving this issue and as a matter of
''time is of the essence" this is our best effort to temporarily re solve the current issue at hand

Cerise irri on pipe , which in fact runs through the Guggenheim property oflot 53 .
The purpose of relocating the irrigation pipe is suc h that during the construction of the
Guggenheim home the house will be better situated within its primary building envelope
for lot 53 . The relocation of the irrigation easement is limited to the existing irrigation
easement location but may be adjusted a few feet le ft or right of its current location. If
during the process of relocating the irrigation pipe or at any time after the Guggenheim
home is complete , the irrigation pipe is damaged , (within the location described on lot 53
that the pipe was disturbed during the Guggenheim Main House and ADU
construction/building envelope) Daniel Guggenheim or any future property owners of lot
53 , will be responsible for repairing the pipe as necessary at hi s expense. Dennis Cerise
and or any future property owner of lot 52 will not be held liable if the irrigation pipe
should become damaged or leak water causing damage to the Guggenheim dwelling. In
addition , Guggenheim will add a trap to the pipe , at Guggenheim 's ex pense, in order to
allow for cleaning of the pipe in case of blockage .
