HomeMy WebLinkAbout6.0 Resolution 84-266STATE OF COLORADO County of Garfield ) • • ss At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held at the Courthouse in Glenwood Springs on Monday , the 27th day of December A.D. 19 84 , there were present: Larry Velasquez , Commissioner Chairman Flaven J. Cerise , Commissioner Eugene "Jim" Drinkhouse , Commissioner Steve Zwick , County Attorney Zwick Mildred Alsdorf , Clerk of the Board wnen the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 84- 266 AN AMENDED RESOLUTION CONCERNED WITH APPROVAL OF THE PRELIMINARY PLAN FOR THE LAKE SPRINGS RANCH PLANNED UNIT DEVELOPMENT WHEREAS, Foster Petroleum Corporation has filed an application witn the Board of County Commissioners of Garfield County for approval of the Lake Springs Ranch PUD Preliminary Plan; and WHEREAS, this matter nas previously come before the Board of County Commissioners for public hearing and decision in regards to said preliminary plan; WHEREAS, it has been indicated to the Board that some confusion presently exists as to the specific conditions of said approval; and WHEREAS, the Board is desirous of eliminating confusion so that the time of final plat approval all parties are on notice of said conditions. NOW, THEREFORE, BE IT RESOLVED, that tne Preliminary Plan of Lake Springs Rancn PUD subdivision, for the following described unincorporated area of Garfield County be and hereby is approved with the following conditions: SECTION ONE Preliminary Plan Conditions. 1. That the applicant demonstrate that central sewage disposal is available to all lots, except those lots snown to have physical limitations at the time of PUD rezoning. 2. That the applicant either dedicate 4.2 acres to tne RE -1 School District or provide cash in lieu of dedication at tne time of Final Plat submittal if the proposed school dedication site cannot be merged with the larger dedicated site in an adjacent development. 3. That the developer agree to make off site road improvements on County Road 114 from the end of the existing nard surface to the northern boundary of the development. That the road improvements to County Road 114 shall at a minimum include tne following: • • (a) The rebuilding (base and surface) of County Road 114 from the end of tne existing nard surface to tne north end ot tne subdivision to County standards, with 24 foot wide cnip and seal driving surtace. (b) Tnat the right of way be realigned and widened including out not limited to the area Known as the Quigley pond. 4. That the following plat notes be placed on any final plat or plats: (a) That all lot owners will be required to use water in accordance with the provisions in Water Court Case No. 3571. (b) That a site specific soils and foundation study may have to be performed by a registered professional engineer licensed in the State of Colorado and be submitted with any building permit application if it is determined to oe necessary by the County Building Department. SECTION TWO All previous action ot the Board of County Commissioners inconsistent herewith and with Resolution No. 80- 63 is nereoy repealed.
