HomeMy WebLinkAbout3.0 Resolution 2004-110STATE OF COLORADO ) )ss County of Garfield ) • 1 111111 Illi! 11111111111111 IJ 111111111 III 1111 1111 663716 11/19/2004 11 24A B1640 P887 M ALSDORF 1 of 3 R 0.00 D 0.00 GARFIELD COUNTY CO At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Plaza Building, in Glenwood Springs on Tuesday, the 7th day of September, 2004, there were present: John Martin Larry McCown Tresi Houpt Don DeFord Mildred Alsdorf Ed Green , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board , County Manager when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2004-1 'j 0 A RESOLUTION CONCERNED WITH THE APPROVAL OF A TEXT AMENDMENT TO THE LAKE SPRINGS RANCH PLANNED UNIT DEVELOPMENT WHEREAS, the Board of County Commissioners of Garfield County, Colorado, received an application from Berkeley Family Limited Partnership and Miriam Berkeley to amend the text of the Lake Springs Ranch Planned Unit Development (PUD); WHEREAS, the Lake Springs Ranch PUD, a property containing approximately 441 acres, was approved as a PUD in 1979 and memorialized in Resolution 1979 — 64 which rezoning approved a plan that envisioned a total of 194 single-family dwelling units; WHEREAS, said text amendment would amend the phasing plan of the PUD such that the first final plat submitted to the County shall include the platting of at least 10% (rather than 25%) of the 194 single-family residential lots within the PUD; WHEREAS, all conditions required by the Board of County Commissioners in Resolution 1979 — 64 shall remain in full force and effect which the exception of the effect of the PUD text amendment discussed herein; WHEREAS, on Wednesday, August 25th, 2004, the Garfield County Planning Commission forwarded a recommendation of approval to the Board of County Commissioners for the proposed amendment; WHEREAS, the Board of County Commissioners held a public hearing on the 7th day of September, 2004 upon the question of whether the text amendment should be • iiilll VIII 1111111 III VIII VIII 1111111 III IIIA III IIII 663716 11/19/2004 11 24A B1640 P888 M ALSDORF 2 of 3 R 0.00 D 0.00 GARFIELD COUNTY CO granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said text amendment; and WHEREAS, the Board of County Commissioners, on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of facts: 1. That proper publication was provided as required by law for the meetings and hearings before the Planning Commission and before the Board of County Commissioners. 2. That the public meetings and hearings before the Planning Commission and the Board of County Commissioners were extensive and complete; all pertinent facts, matters and issues were submitted; and that all interested parties were heard at those hearings. 3. That the proposed text amendment to the Lake Springs Ranch PUD is in compliance with the recommendations set forth in the Comprehensive Plan for the unincorporated areas of the County. 4. That the PUD text is consistent with the efficient development and preservation of the entire PUD [and the modification] does not affect in a substantially adverse manner either the enjoyment of land abutting upon or across a street from the PUD, or the public interest, and is not granted solely to confer a special benefit upon any person. 5. That the application has met the requirements of the Garfield County Zoning Resolution of 1978, as amended, specifically Sections 4.12.03. 6. That the proposed PUD Amendment has been determined to be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that based on the determination of facts set forth above, the request is approved to amend the text of the Lake Springs Ranch PUD such that the first final plat submitted to the County shall include the platting of at least 10% (rather than 25%) of the 194 single-family residential lots within the PUD.
