Dear Mark:
r represent Jay and susan zarr, who own Lot 7 in MitcherlCreek. They built an addition onto their house in 1989-90, with acounty building pernit and with approval from the homeownersassociation. Later, they found out -tt their surprise that theiraddition encroached onto Lot B. The present owners of Lot g areMark and susie straus, who are represented by Hugh warder.

The parties have reached a settlement which would requj-re theadjustment of the lot line as shown in the attached *.p. werespectfully request that the County approve this adjustment. ftis only for an internal 1ot line, ana a6e= not affect lny easementsor rights of third parties. This adjustment will also involvechanging the buirding envelope to fo116w the new Iot 1ine.
rf the commissioners approve this request, we will immediatetyprepare and submit. a plat amendment in accordance with countlrregulations, for signature by the conrnission. Time is of thaessence.

Dear Ken and Jim:
As we discussed by phone, I represent Jay and. susan zarr, who
owns Lot 7 in Mitche}l creer. -rrrev huilt an addition onto their
house in 1989-90, with a county uuilaing permit-and-with approvar
from the homeowners associatio-n. Later, they found out to their
surpri-se that-in"ir addition encroached onto Lot 8' The present
owners of Lot g are Mark and susie Straus, who are represented by
Hugh Warder.
The parties have reached a settlement which would reguire the

relpectfully reguest approval from the Mitchell Creek Homeowners
Association foi=ini= a^Cfiustrn-nt. It is only for an-internal lot
line, and does not affect any easements.or rignts.of .third parties'
This adjustme"t riff-if=o iniolve changing the building envelope to
foIlow the new lot line.
We are also asking the Garfield County Commissioners to
approve this reguest on December 7, Lg92. If they do so we will
immediatery piepiie ana submit a plat amendment in accordance with
county r"grrruii;;;; i"i signature^by the commission' rt would also
;;ili;" iignature by a representative of the Homeowners
Association.
Time is of the essence, ds the zarrs are trying to close a
sale to David and WendY Jeffers'
