Applicant seeks to remove a plat note that limits the number of dogs to one per residence in the subdivision, currently one dog per household. The PUD and Preliminary Plan approvals both mention the limitation on number of domestic animals permitted — the plat note was the result of this concern. The Applicant should contact the local Colorado Parks and Wildlife office to discuss removal of this restriction. The County will send a referral seeking comment from CPW on this request — if CPW has concerns about the removal of the restriction it may result in staff not being able to suppert the request. The rerroval of a plat note will require that the subdivision be replatted, this will require each owner to be a party to the amendment. As well, Aspen Valley Land Trust holds a conservation easement on the open space and as an easement holder will also be a party to the application. The amended plat will require signatures of all owners, mortgagees, and AVLT. A Pre -application Conference. B. Application Submittal. (Three paper copies, one electronic copy in specified format) C. Determination of Completeness. Ds. Schedule Director decision date — or if the Director refers the application to the BOCC then a Board meeting date will be scheduled. E. Notice documents will be provided to the Applicant for mailing. F Additional copies requested and referral agencies notified of application. G. Evaluation by Director/Staff resulting in a Staff Report to the Director or Board dependent upon the referral of the application. H. Director Decision or a Public Hearing resulting in a decision for approval, approval with conditions or denial. 1. BOCC plat signature. Public H paring notices for this application will require notice to owners within 200 feet of the subdivision and notice to any mineral owner of the subject subdivision - pursuant to Section 4-101.E. The administrative review does not typically require a public hearing, however the Director may refer this for Board of County Commissioners review Referral will be sent to the following agencies: > Colorado Parks and Wildlife > County Surveyor ➢ Others as may be deemed appropriate upon review of the application General Application Materials: a. Cover letter explaining the request; b. Deed and Title Commitments for each of the properties to demonstrate ownership and encumbrances; c. Application form and fee — application to be signed by all owners, or a letter of authorization provided; d. Agreement to Pay Form; e. Statement of Authority for any properties owned in trust, LLC or Inc.; f. Mineral Ownership — Names and mailing address of any severed mineral rights owner — Applicant is required to do research to determine if there are severed mineral owners. This information may be found in a deed, title commitment or in the Clerk's Office; B Vicinity Map 4-203 C.; C Copy of existing plat of the properties; D Draft Amended Final Plat — see description in 5-402 F. (all owners and mortgages must be listed and must sign prior to BOCC review); E. Copy of pre -application conference form; F. Subdivision Improvements Agreement — may request waiver; G Development Agreement — may request waiver; H. CCR's — may request waiver if none exist or none are proposed. Applicant may request waiver of submittal requirements upon demonstration of crteria in Section 4-202 of the LUDC. This application will be subject to the following fees and deposit requirements: Planning Review Fees: $ 100.00 Plus additional time at staff hourly rate of $40.50 County Surveyor: $ hourly rate for review Recordation: $ TBD Total Deposit: $ 100.00 General Application Processing Planner -eviews Ocase for completeness and sends to referral agencies for comments. Case planner contacts applicant and sets up a site visit. Staff reviews application to determine if it meets standards of review. Case planner makes a recommendation of approval, approval with conditions, or denial to the appropriate hearing body.
