Snowmass Land Company TG Malloy Consulting, LLC. The property is located west of the intersection of County Road 115 and Cattle Creek Road on Missouri Heights. ISSUE On June 2,2003, the Board of County Commissioners granted Preliminary Plan approval to the Ranch at Coulter Creek Subdivision, subject to a number of conditions. One specific condition, the subject of this memorandum, dealt with the physical water supply for the Subdivision. Condition No. 17 fully reads: The Board of County Cornmissioners accepts the recommendati,on of the State Engineer's Office detailed in the May, 29, 2003, letter of Kenneth Knox. Prior to Final Plat approval, the Applicant shall provide the County with a copy of afinal Water Court Decreefor the planfor augmentationfor the Subdivision as stated in the letter dated May 29, 200j from the ffice of the State Engineer. Prior to recording of the Final Plat, the Applicant shall provide the County with copies of approved well permits for each well which is to be part of the water supply system. The Applicant agrees to pay/6V the iibrviices of a private consultant to the Board of County Comiissioners to review the Zancanella and Associates' report regarding already drilled wells should the State Engineer not clarify its lack of comments on the physical adequacy of the water supply in the May 29, 2003, letter. In accordance with the above-mentioned condition of approval, the Applicant is formally requesting that the County retain a hydrologist or a qualified engineering consultant for the purpose of reviewing the report prepared by Zancanella and Associates, in order to provide the Ranch at Coulter Creek Subdivision Preliminary Plan Board: 7ll4l03 Page2 County with an opinion as to the adequacy of the wells that have been drilled on the property and are proposed to serve as the physical water supply for the Subdivision. Staff understands that the Applicant has been working with the State to provide clarification on their position on the water supply issue with out any outcome. The Applicant has outlined their request in the attached letter, Exhibit A. II.ACTION The Board shall move to allow the Planning staff authority to retain a consultant to review the Zancanellaand Associates report to determine the adequacy of the physical water supply for the Ranch at Coulter Creek Subdivision. Dear Tamara: As a follow up to our telephone conversation today, I am submifiing this letter on behalf of the Snowmass Land Company and request that it be included in the packet for the July 14fr regular meeting of the Board of County Commissioners. Pursuant to Condition 17 of Resolution 2003-41, Snowmass Land Company herby formally requests that Garfield County retain a hydrologist or other qualified engineering consultant for the purpose of reviewing the report prepared by Zancanella and Associates and providing the County with an opinion as to the adequacy of the wells that have been drilled on the property and are proposed to serve as ttie physical water supply for the Subdivision. The wells in question are referred to as Lot #24 Well, RCC Well #5 and RCC Well #7. Snowmass Land Company agrees to pay the fees associated with this review as required pursuant to Resolution2003-4 subject to the condition that they be allowed to review the proposal(s) offered by candidate consultants and approve the fee amount prior to the County entering into any contractual arrangement for these services. As you are aware, Condition No. l7 of Resolution 2003-4lprovides a process for independent verification of the physical adequacy of the proposed water supply should the State Engineer not clarifr its lack of comment regarding this issue in its referral letter of May 29,2003. This process requires that the Applicant pay for the services of a private consultant to review the report prepared by Zancanella and Asiociatei related to the "already-drilled" wells on the property. Since the June 2"d hearing with the Board of County Commissioners, at which this condition was discussed, Scott Miller of Patrick, Miller & Ikopf, P.C., has been attempting to get the State to clarifu their position on this issue to no avail. Since it is the intent of the Snowmass Land Company to submit an application for Final Plat for the project in early August, we believe it would be prudent to go ahead with independent verification. Our primary concern is that the Final Plat review not be held up due to incomplete information on the proposed water supply plan. It is our hope that the necessary analysis can be completed prior to the end of the first week of August and we are prepared to cooperate in any way we can to expedite the review by the private consultant. To this end we look forward to working with the Staffand the selected consultant on this matter and we stand ready to provide any information necessary to complete the analysis. We also request direction from the County as to how you would like to handle payment of the cost of the selected consultant's services.
