of M�i /e L , 1989, by and between RIFLE SERVICE PARK OWNERS
ASSOCIATfOON hereinafter referred to as "Developers"), and the Board of
County Commissioners of Garfield County, Colorado, (hereinafter referred
to as the "County").
WITNESSETH:
WHEREAS, an Agreement dated February 26, 1979, between the
previous Developer, Pierre Barthelemy, and the County was executed as a
condition of approval of final plat of the Rifle Service Park P.U.D.
Subdivision (hereinafter referred to as "P.U.D.") and
WHEREAS, the Developers now desires to complete the construction
and installation of all public improvements identified in Exhibit "A" of
the previous agreement by October 1, 1991; and
WHEREAS, the Developers owning land adjacent to Aspen Road, have
agreed to pay their proportionate share of the cost for the remaining
improvements; and
WHEREAS, the Developers agree that no additional building permits
will be issued for any lot along Aspen Road until the improvements
adjacent to the lot are completed; which shall also bind any heirs,
assigns or purchasers of any affected lot to be obligated to complete the
improvements associated with their lot. Such subsequent persons shall be
advised by Developers of this agreement.
WHEREAS, the County is agreeable to allow the property to be
developed in the manner proposed; and
WHEREAS, the parties desire to amend the previously approved
Subdivision Improvements Agreement and amendments thereof, to allow for
the extension of time to post a letter of credit or complete the agreed
upon public improvements.
NOW, THEREFORE, for and in consideration of the premises and the
following mutual covenants and agreements, the parties hereby agree as
follows:
1. That prior to issuance of any new building permits for
lots along Aspen Road, all improvements adjacent to the
lot and set forth in Exhibit "A" shall be completed or a
letter of credit posted with the County in an amount equal
to the cost of completion of the required improvements.
2. The public improvements set forth in Exhibit "A" of the
Subdivision Improvements Agreement entered into by the
Developers and the County shall be completed on or
before October 1, 1991.
3. In all other respects, all terms, conditions and
agreements of the Subdivision Improvements Agreement,
referred to above, shall remain unaltered and in full
force and effect.
