when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 81-55
RESOLUTION CONCERNED WITH THE APPROVAL OF A ZONE DISTRICT
AMENDMENT TO THE GARFIELD COUNTY ZONING RESOLUTION AND
PLANNED UNIT DEVELOPMENT PLAN OF RIFLE SERVICE PARK REQUESTED
BY PIERRE BERTHELEi1Y.
WHEREAS, this Board of County Commissioners and Pierre
Berthelemy has heretofore filed a petition with the Board of
County Commissioners of Garfield County to rezone the herein
described property in Garfield County from Agicultural/
Residential/Rural Density Zone District to Planned Unit
Development Zone District and to approve a Planned Unit
Development Plan for Rifle Service Park, a Planned Unit
Development; and
WHEREAS, a public hearing was held by this Board on
December 29, 1980; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the General Plan for the unincorporated area of the
County, comments of the Garfield County Planning Department,
comments of public officials and agencies, and comments from
all interested parties, this Board finds as follows:
1. That proper publication and public notice was
provided as required by law for the hearing before the Board;
2. That the hearing before the Board was extensive
and complete, that all pertinent facts, matters and issues
were submitted and that all interested parties were heard
at that hearing;
3. That the Garfield County Planning Commission has
recommended to this Board that the requested rezoning be
granted;
4. That the proposed zoning is in compliance with the
recommendations set forth in the General Plan for the unincor-
porated area of the County;
5. That the proposed land use will be compatible with
existing and permitted land uses resulting from the natural
and planned expansion of the City of Rifle;
6. That changing conditions and an error in the adop-
tion of the present zone district map clearly require amendment
to the Zoning Resolution;
7. That, because the proposed planned unit development
is to be devoted to commercial purposes and to house no perma-
nant or temporary residents, the 25% open space requirement
is not warranted;
8. That, other than in the foregoing- particulars,
the requested zone change amendment and plan approval are
in general conformity with the General Plan for Garfield
County, Colorado, and meet all requirements of the Zoning
Resolution of Garfield County, and further that the requested
Planned Unit Development is suitable and appropriate for
the subject property considering the location, condition
and circumstances of said property, and that the proposed
amendment implements the purposes and meets the standards
and requirements of the Planned Unit Development provisions
of the Garfield County Zoning Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Garfield County, Colorado:
Section 1. That the petition of this Board of County
Commissioners and Pierre Berthelemy for a zone change from
Agricultural/Residential/Rural Density Zone District to
Planned Unit Development Zone District for the following
described unincorporated area of Garfield County be approved,
subject however, to the conditions contained herein:
A tract of land situate in the Sz of the SEq
of Section 10, and Lots 1 and 2 of Section 15,
all in Township 6 South, Range 93 West of the
6th Principal Meridian being more particularly
described as follows:
Beginning at the intersection of the East line
of said Section 10 with the North right of way
line of U.S. Highway No. 6 & 24 whence the
Southeast corner of said Section 10 bears
S00°03'00"E 517.12 feet; thence S63°28'52"W
1409.31 feet along said Highway right of way
fence line to the Easterly right of way fence
line of a county road; thence N09°38'38"E
94.76 feet along said county road right of way
fence line; thence N24°06'33"E 806.94 feet
along said county road right of way fence
line; thence North 146.89 feet; thence
N24°06'33"E 8.69 feet; thence S89°50'00"E
550.77 feet; thence N00°10'00"E 448.72 feet
to a fence line; thence S89°44'13"E 359.22
feet along said fence line to the East line
of said Section 10; thence S00°03'00"E 801.01
feet along said East line of Section 10 to
the point of beginning, containing 18.778
acres more or less.
Section 2. That the Planned Unit Development shall
consist of one Zone District, the boundaries of which shall
be the same as Rifle Service Park, a Planned Unit Development,
which district shall be designated as Planned Unit Development
District, also designated P/U/D.
Section 3. That the uses permitted within said dis-
trict, together with the regulations affecting the usage of
the lands contained therein, shall be as follows:

conducted within a building;
(2) All storage of materials whall be within a building
or obscured by a fence;
(3) All loading and unloading of vehicles is conducted on
private property;
(4) No dust, noise, glare or vibration is projected beyond
the lot;

cabinetry, glazing, machining, printing, publishing,
plumbing, sheet petal and contractor's yard and shop;

MINIMUM SETBACK:
(1) Front yard: Arterial streets: 25 feat form front
lot line.

(2) Rear yard: 7.5 feet from rear lot line
(3) Side yard: 10 feet from side lot line or the
height of the principal building,
whichever is greater.
