Box 1989 Glenwood Springs, CO 81602 ATTN: Steve Boat BUILDING & PLANNING DEPARTMENT RE: DIRECTOR'S DECISION Amended Final Plat Riverbend Filing 5, Lots 7 & 8 (File No. FPAA-7366) Dear Steve: This letter is provided to you as the owner representative of the Amended Final Plat Application for Lots 7 & 8 Riverbend Filing No. 5 Application. Your Application has been reviewed in accordance Section 5-305, Table 5-102 and Section 4-103 of the Unified Land Use Resolution of 2008 as amended (ULUR). Said provisions require a Decision by the Director of the Building and Planning Department on whether to approve, approve with conditions, or deny the request. A decision is hereby issued regarding your Application for an Amended Final Plat for Lots 7 & 8 Riverbend Filing No. 5. The Director's Decision is to approve the Application subject to the following Conditions: 1. That all representations of the Applicant contained in the Application submittals shall be conditions of approval unless specifically amended or modified by the conditions contained herein. 2. All requirements from the County Surveyor shall be met prior to submittal of the plat for final execution and recording. 3. Prior to the execution and recording of the Amended Plat, the Applicant shall provide a Common Wall Agreement for review and acceptance by the County Attorney's Office. The Agreement shall address separate utility services for the duplex units and shall be recorded concurrently with the filing of the plat. 4. Prior to execution and recording, the Amended Plat shall be subject to final review and acceptance by the County Attorney's Office, including all certificates, plat notes and signature blocks. 5. The adjustment of the lot line between Lots 7 and 8 shall maintain the required minimum lot size for both lots (14,000 sq.ft.) and shall maintain the 108 Eighth Street, Suite 401 • Glenwood Springs, CO 81601 (970) 945-8212 • Fax: (970) 384-3470 1 minimum side yard setback for the existing duplex of 10 ft. or'/ the height of the principle building whichever is greater. 6. The Plat shall include a plat note indicating the purpose of the Amended Plat (creation of separate ownership interests for the duplex units and maintaining the required side yard setback for Lot 8) and a plat note establishing that all existing plat notes and conditions applicable to the lots and Riverbend Filing No. 5 shall remain in effect. 7. All conditions of approval and edits to the proposed plat shall be completed and a mylar of the proposed Amended Final Plat shall be provided to the County in a form ready for signatures and recording within 90 days of the date of the Directors Decision. The ULUR requires notification to the Board of County Commissioners for their review and potential call-up of the application for a public hearing. The Board review is for a period of 10 days commencing on the date of the Director's Decision. The call-up period shall expire on January 28th. The Amended Final Plat will be scheduled on the Board of County Commissioner's consent agenda after expiration of the call-up period and once the conditions of approval have been met.
